Unfortunately, Altenberg had failed to assign the rights to the projects the fund controlled by Jefferson and Murphy. Following the sale of the Beltline Projects, Altenberg attempted to recoup losses and follow through on remaining projects using proceeds from the sale, but was short and needed additional funding from the plaintiffs to cover the shortfall.
Jefferson and Murphy had lost confidence in Altenberg and suggested selling the remaining projects. Altenberg began to make questionable changes to documentation concerning projects, including dating documents much earlier than their meta data would support.
Trial
Getting to trial was a painstaking process of delays on the part of Altenberg. The original proposed trial date was for September of 2018. On two separate occasions, Altenberg’s counsel withdrew, leaving him with 30 days to acquire new counsel.
Twice Altenberg failed to obtain new counsel within the 30 day period and petitioned the courts for extensions while he found new counsel. His final petition for an extension was denied in May of 2019, citing “questionable behavior” on the part of the defendant. Trial was set for September of 2019.
