ATLANTA, GA — The clash between Fulton County District Attorney Fani Willis and the Georgia Senate Special Committee on Investigations has now reached the state’s highest court, and the stakes could not be higher. At issue is whether Willis can successfully argue that a legislative subpoena demanding her testimony expired with the close of the 2024 session — or whether she must finally face tough questions about her secret relationship with lead prosecutor Nathan Wade and the nearly $720,000 in taxpayer funds his appointment generated.

The committee insists this is no ordinary skirmish over procedure. In their words, the subpoena fight presents a “matter of first impression” — a legal issue no Georgia court has ever squarely addressed. And they’re right: never before has the state’s Supreme Court had to decide whether the General Assembly’s subpoena powers evaporate at the end of a legislative session. For Willis, this untested legal ground offers her best shot at sidestepping compliance. For the committee, it’s a chance to cement oversight authority and probe what they allege may amount to misconduct at the very heart of one of the most politically explosive prosecutions in state history.

Willis’ Maneuvers

Willis has argued in her supplemental brief that the subpoena “essentially expired” once the new General Assembly was sworn in on January 13, 2025. She claims the dispute is now moot because the subpoena was never reissued. But here’s the problem: there’s no evidence she was ever told the subpoena was withdrawn, nor that the committee’s investigation had ended. Instead, legal observers say it looks very much like a carefully crafted delay tactic.

“No other Georgia court, including this one, has decided that issue,” Willis argued. Her position reframes the dispute as a novel constitutional question rather than a straight compliance fight. Critics of Willis’ legal maneuvering, say this is less about legal merit and more about buying time. The longer she delays, the further she pushes accountability out of reach — and the harder it becomes for the public to learn whether her relationship with Wade compromised the integrity of the Trump prosecution.

Judge Already Rejected Her Theory

It’s worth noting that Willis already tried this argument once. Back in February, Fulton County Superior Court Judge Shukura L. Ingram rejected her claim, calling it “absurd” to suggest subpoenas simply vanish when the legislative calendar resets. Willis lost that round, but rather than testify, she appealed — escalating the matter to the Georgia Supreme Court.

Meanwhile, she did settle with the committee on a separate subpoena demanding documents. But the witness subpoena — the one that could compel her to testify under oath about Wade and the payments — remains unresolved. That unresolved subpoena now sits at the center of this constitutional showdown.

Let’s be clear: the committee isn’t just chasing paperwork. They are asking the Georgia Supreme Court to affirm their authority to compel testimony from a sitting district attorney accused of misconduct. If Willis prevails, future investigations into prosecutors — or any public officials — could be handcuffed by a loophole.

And if the committee is right, Willis faces not just career-ending consequences but possibly criminal exposure. Misusing public funds, concealing conflicts of interest, or misleading the legislature are not mere ethics violations — they carry real penalties.

The optics matter, too. Every time Willis resists testifying, the public perception shifts further against her. Georgians are left asking: what is she afraid of? If her conduct was above board, why fight so hard to avoid the witness chair?

The Lawyers at the Helm

Willis is represented by former Governor Roy E. Barnes and John R. Bartholomew IV of The Barnes Law Group. The committee is represented by Josh Belinfante, Vincent R. Russo, and Jane Ashley Ravry of Robbins Alloy Belinfante Littlefield.

What’s Next

The case, Fani T. Willis v. Bill Cowsert et al., Case No. S25A1236, now sits squarely in the hands of the Georgia Supreme Court. The justices must decide whether to uphold Judge Ingram’s ruling and force Willis to comply, or to endorse her theory that subpoenas self-destruct when a new session begins. Briefing is complete, and arguments are expected soon. A ruling will set precedent not only for Willis but for the balance of power between the legislature and prosecutors across Georgia.

Either way, this is one of those rare “first impression” fights that will reverberate far beyond Fulton County.
