Molestation Allegations Rock Kern County Political Dynasty as SCRIVNER Act Becomes Law

Molestation allegations involving former Kern County Supervisor Zack Scrivner have brought renewed attention to one of the region’s most connected political families, while the California Legislature has enacted a law bearing the family’s name that changes how prosecutors must handle certain cases involving elected officials and alleged sexual crimes against minors.

Scrivner, 52, built a lengthy political career in Kern County, serving on the Bakersfield City Council and the Kern County Board of Supervisors before resigning in 2024. He also worked as a district director for a state lawmaker and previously served as a field representative and political protégé of former U.S. House Speaker Kevin McCarthy.

Allegations That Changed the Scrivner Family

The allegations center on an April 23, 2024, incident at the Scrivner family home. According to accounts provided by Scrivner’s estranged wife, Christina Scrivner, and their son Robert to KGET, the family’s younger daughter allegedly told Robert that her father had molested her.

Robert has described confronting his father and a violent confrontation that followed. He said Scrivner displayed a firearm and at one point allegedly pointed it directly at his face. Robert also said he stabbed his father with a pocketknife during the confrontation.

These accounts are allegations and have not resulted in a criminal conviction for a sex offense against Scrivner. The California Attorney General’s Office ultimately charged Scrivner with felony child abuse and illegal possession of assault weapons, but did not file a sex-crime charge. The AG’s office said it reviewed the facts and filed charges it believed could be proved beyond a reasonable doubt at trial.

The Scrivner Political Dynasty

The case attracted particular attention because politics has been deeply intertwined with the Scrivner family in Kern County.

Zack Scrivner spent years in elected office, including seven years on the Bakersfield City Council and roughly 14 years on the Kern County Board of Supervisors, according to KGET’s recent investigation. He was also connected to Kevin McCarthy during McCarthy’s rise through California and national Republican politics.

Other members of the family have also held public positions. Scrivner’s mother, Kathy Scrivner, has served on the Kern High School District Board of Trustees. His estranged wife, Christina, served on the Tehachapi City Council before joining the Kern Community College District board. His aunt, Cynthia Zimmer, is Kern County’s district attorney.

Zimmer recused her office from the criminal case because of the family relationship, and the California Attorney General’s Office took over the prosecution.

The concentration of political and governmental relationships within the family has fueled public scrutiny, although claims that particular officials improperly influenced the case remain allegations rather than established findings.

Mental Health Diversion Became a Central Issue

Scrivner was permitted to enter a mental health diversion program rather than face a conventional criminal trial on the charges filed against him. Under California's diversion framework, eligible defendants can receive treatment under court supervision, and successful completion can result in dismissal of the criminal charges.

Christina and Robert Scrivner publicly criticized the outcome and traveled to Sacramento seeking changes to California law. A separate proposal backed by state Sen. Shannon Grove sought to restrict eligibility for mental health diversion in certain serious cases.

The controversy eventually became part of a broader legislative effort concerning the prosecution of elected officials and allegations involving children.

What Is the SCRIVNER Act?

California Assembly Bill 2273, known as the SCRIVNER Act, was authored by Assembly member Jasmeet Bains. The enacted legislation formally names itself the Sexual Contact and Rape Investigation, Victims’ New Enforcement Rights Act, or the SCRIVNER Act.

The law makes several changes to California criminal procedure.

First, it requires the California Department of Justice, after completing an investigation of an elected official and determining that specified crimes against a minor occurred and that the case is appropriate for prosecution, to bring charges within 30 days. The law also states that failing to meet that 30-day period does not prevent prosecution later.

Second, the law addresses situations in which facts alleged in charging documents or disclosed during a preliminary hearing could constitute offenses that would make a defendant ineligible for mental health diversion, but prosecutors did not charge those offenses. In such circumstances, prosecutors must state on the record why those charges were not pursued and whether they consulted with the victim about the charges that were filed.

The law specifically excludes several serious offenses from diversion when they are the current charged offenses, including rape, certain offenses requiring sex-offender registration, lewd or lascivious acts involving children under 14, and continuous sexual abuse of a child.

When Did the SCRIVNER Act Become Law?

AB 2273 was introduced by Bains on February 19, 2026. It subsequently passed both chambers of the California Legislature before being approved by Gov. Gavin Newsom on September 18, 2026. It was filed with the California secretary of state the same day and became Chapter 298 of the Statutes of 2026.

Bains' office said the legislation received unanimous approval in both the Assembly and Senate before Newsom signed it.

The law's connection to the Scrivner case has made it a closely watched example of how a specific criminal case can lead to broader changes in state law.
