MindGeek, formerly known as ManWin, the parent company of Pornhub, is being sued by a mom after a user raped her 14-year-old son and posted videos of assaults on the site.

The "traumatized" mother’s attorney, Parker Miller, from Alabama-based law firm Beasley Allen Law, represents "CV1" and his mother.

Miller claims that the video footage distributed by the site was "clearly" of “CV1” an underaged child.

Franklin was charged and convicted of “two counts of sexual exploitation of a child, one count of advertising child pornography, and two counts of the distribution of child pornography.”  And sentenced to 40 years in prison.

Damages from Mindgeek are being sought for “a permanent injury" to the victim, a minor.

Rocky Franklin, 36, was convicted of drugging and raping the child known only as "CV1." He then filmed the ordeals. And uploaded the footage to Pornhub for profit. 

Franklin was a trusted friend of the plaintiff's family but was not related to them.

Mindgeek owns porn sites

Along with Pornhub, parent MindGeek owns a myriad of adult-entertainment sites, which includes RedTube and YouPorn. 

The site has had previous claims related to videos of child sexual assault and sex trafficking.

In 2020, allegations that Pornhub hosts videos depicting child porn caused both Visa and Mastercard to cut ties with the platform.

  According to the suit, Franklin spent most of 2019 abusing children for content to post on Pornhub. The porn-for-profit scheme made money for Pornhub and convicted child rapist.

Franklin’s account had multiple videos of "CV1" available for sale. Each video costs $15 to $20 to download. And some of them had received over 150,000 views.

The “CV1” video titles attempt to capitalize on the fact that the victim is an underage child. Titles include "my favorite nephew" and "An Uncle's Secret." And some of the titles are too graphic for public disclosure.

The lawsuit claims that Pornhub provided "assistance, platform, content mandates, and edits" to help generate "the maximum amount of views and drove the maximum volume of traffic for the mutual benefit of the Defendants and their unlawful scheme."

In the lawsuit it is alleged the company "never informed the authorities about the identity of Defendant Franklin, the fact he posted child sexual violence, or the fact that child sexual violence was being utilized on their platforms for profit to their mutual benefit."

The platform issued a statement saying, "MindGeek is aware that a lawsuit has been filed in federal court in Alabama. We are sympathetic to any victim who has suffered from a trusted person's abuse, which is why we have zero tolerance for illegal material or the bad actors who attempt to upload it.”

"In this case, we cooperated with authorities, leading to this criminal's sentencing of 40 years in federal prison. MindGeek has instituted the most comprehensive safeguards in user-generated platform history to mitigate the ability of criminals to successfully upload illegal material," the statement said.
