Virginia Federal Judge Upholds Paul Weiss Refusal in Google Defense

A Virginia federal judge, Leonie M. Brinkema, made a resounding decision on Monday to maintain Paul Weiss refusal. The decision maintains Paul Weiss Rifkind Wharton & Garrison LLP as the spearhead in Google's defense against the U.S. Department of Justice's ad tech monopolization case. She ruled that there exists no conflict of interest arising from the firm's prior representation of Yelp and a newspaper trade group in a separate antitrust matter.

Judge Brinkema delivered her ruling last week, rebuffing Yelp.com and News/Media Alliance's contentions that the firm's prior representation of them could lead to economic consequences down the line in the Google case.

"Paul Weiss' role in representing Google in the ad tech litigation neither poses a direct adversarial conflict nor presents a substantial risk of limiting the firm's representation due to its previous dealings with Yelp and NMA," Judge Brinkema stated in her memorandum opinion filed on Monday.

Furthermore, neither Yelp nor NMA is a party to the ongoing litigation, and no liabilities will be imposed on them. The judge clarified that the focus of this action is exclusively on Google's ad tech business, unrelated to its previous work involving Yelp and NMA, which centered on Google's internet search technology. Notably, those former representations were led by lawyers who have since left the firm, with the exception of Daniel Crane, who is no longer involved in the ad tech litigation.

Judge Brinkema emphasized, "Moreover, neither Yelp nor NMA are parties in this litigation. As such, Yelp and NMA have failed to provide 'patently clear' evidence demonstrating how specific confidential information Paul Weiss may have obtained during the previous representation is substantially related to the dispute in the instant litigation."

However, Judge Brinkema stipulated that any Paul Weiss attorneys and support staff with prior involvement in representations related to Google's alleged anticompetitive conduct on behalf of Yelp or NMA should be barred from participating in the Justice Department's case.

Yelp and NMA argued that they had engaged Paul Weiss for counsel on antitrust investigations into Google in 2016. They contend that Paul Weiss still holds privileged and confidential information related to their representations, which has now become a conflict as the firm represents Google in the ad tech case.

Last Friday, Judge Brinkema, during a brief hearing, firmly asserted that it's insufficient for Yelp and NMA to merely speculate about potential economic impacts in the future due to the DOJ case. She also declared that the case is not "substantially related" to Paul Weiss' past work for Yelp and the trade group, which involved advocating for DOJ enforcement that ultimately led to the current search monopolization case in a D.C. federal court bench trial.

In her opinion issued on Monday, Judge Brinkema highlighted that Yelp and NMA had not presented "patently clear" evidence indicating that Paul Weiss attorneys had provided legal advice on Google's ad tech business or received confidential information related to that specific area.

Furthermore, Yelp and NMA themselves admitted that their past advocacy with the DOJ focused on internet search rather than advertising technology. Judge Brinkema underscored, "This admission undermines the argument that the underlying issues involved in Paul Weiss' representation of Yelp and NMA are substantially related to the issues in the ad tech litigation."

The Justice Department initiated the lawsuit in January, accusing Google of monopolizing the market for the technology used to sell and place third-party website advertisements, known as display ads.

At Friday's hearing, Brandon Kressin of Kressin Meador LLC, representing Yelp and NMA, pointed out the significant revenue generated by publishers through online ads and mentioned that Yelp, serving as both a customer of Google's ad services and a "horizontal competitor" with its own ad server and tech products, finds itself in a similar situation. While several NMA members have sued Google, neither the trade group nor Yelp has directly taken legal action against the tech giant.

Yelp and NMA contended that they didn't need to produce evidence since Paul Weiss had already provided their materials to Google.

In response, Howard M. Shapiro of WilmerHale, representing Paul Weiss, confirmed, "that none of the lawyers who billed time to the firm's representation of Google in this action has accessed any Yelp or NMA documents stored on Paul Weiss's document management system."

As of late Monday, Paul Weiss, Google, and counsel for Yelp and NMA had not responded to requests for comment.
