MoreMarrone Settles DuPont Fee Spat With Co-Counsel

In a dramatic turn of events reminiscent of a high-stakes poker game, two legal titans, MoreMarrone LLC and Stephan Zouras LLP, have reached an eleventh-hour settlement in their intense feud over a whopping $1.8 million in attorney fees. This resolution came just as the curtains were about to rise on a potentially explosive trial.

The Heart of the Dispute: The DuPont Class Action Spoils

This legal thriller began unfolding around the substantial sum amassed from a victorious class action lawsuit against the corporate giant DuPont. Philadelphia's own MoreMarrone LLC, in a strategic move last week, agreed to write a check of $310,000 to their erstwhile ally, Stephan Zouras LLP. This sum, albeit substantial, falls short of the initial $335,000 MoreMarrone had vowed to disburse.

By striking this deal, MoreMarrone has effectively dodged a courtroom showdown. Prior federal judicial rulings had acknowledged Stephan Zouras's legitimate stake in the DuPont bounty. However, with no concrete fee-sharing framework in place, a jury would have been tasked with untangling the complex web of financial contributions – a scenario now rendered moot.

The Controversy: Accusations of a "Shakedown Attempt"

In a candid revelation to Law360, Thomas Marrone of MoreMarrone described Stephan Zouras's legal maneuvering as nothing short of a "shakedown attempt." He pointed to the stark contrast between his willingness to pay over $335,000 three years prior and the current settlement amount, implying a victory of sorts in this financial tug-of-war.

Representatives for Stephan Zouras have maintained a stoic silence, offering no immediate comment on this development.

The Origin Story: DuPont Lawsuit and the Alliance

The saga began in 2012 with MoreMarrone and Greenblatt Pierce Funt & Flores (now known as Weir Greenblatt Pierce LLP) championing the cause of workers wronged by DuPont. Stephan Zouras entered the fray as co-counsel in 2018, but crucially, no formal agreement on fee division was penned.

Post-victory, as the district court handed the substantial $1.8 million to MoreMarrone, it left the division of this legal windfall to the firms' discretion. This led to Stephan Zouras staking a claim for $573,000, significantly more than MoreMarrone's offer of $325,000.

Judicial Endorsement of Stephan Zouras's Contributions

Both Magistrate Judge Martin Carlson and U.S. District Judge Malachy E. Mannion earlier validated Stephan Zouras's contributions to the successful lawsuit. However, MoreMarrone's objections on the grounds of an alleged enforceable contract were overruled, paving the way for a trial.

MoreMarrone Settles DuPont Fee Spat With Co-Counsel : Mediation and Marrone's Defiance

The case, set for a December trial, took a turn when Judge Mannion steered it towards mediation last month. In a defiant tone, Marrone condemned Stephan Zouras's tactics, vowing resistance to any further financial pressure.

Legal Representation: The Battle Lines

Stephan Zouras's legal front was manned by its own David Cohen, Ryan Stephan, and James Zouras, while MoreMarrone's banner was held by Kyle Heisner of Hangley Aronchick Segal Pudlin & Schiller.
