Questions about Biden cognitive issues surround the former President. This is once again in the national spotlight as a legal battle over the release of audio recordings threatens to revive questions about his memory and mental acuity. 

The Justice Department is preparing to provide recordings of Biden's 2016 and 2017 interviews with ghostwriter Mark Zwonitzer to the House Judiciary Committee unless federal courts intervene, while a separate lawsuit seeks public release of the same recordings.

The dispute has renewed debate over Biden's cognitive abilities before and during his presidency, an issue that dominated much of the 2024 presidential campaign and has continued to generate political controversy.

DOJ Plans to Release Recordings That May Reveal Biden Cognitive Issues

The Justice Department has indicated it intends to provide approximately two hours of audio recordings to the Republican-led House Judiciary Committee within the coming weeks unless an appeals court blocks the move.

The committee, chaired by Rep. Jim Jordan, has sought the recordings for years as part of its oversight investigations.

At the same time, the Heritage Foundation is pursuing public disclosure of the recordings through a Freedom of Information Act lawsuit.

Litigation Continues

Last week, U.S. District Judge Dabney Friedrich ruled that the Justice Department acted within its authority in deciding to release the recordings after appropriate redactions.

The judge noted that many of Biden's privacy concerns had been addressed because references to highly personal matters—including illnesses, deaths and private family members—had already been removed.

Recordings Stem from Classified Documents Investigation

The interviews were conducted while Biden worked with author Mark Zwonitzer on his memoir, Promise Me, Dad.

During Special Counsel Robert Hur's investigation into Biden's handling of classified documents, prosecutors reviewed those recordings to determine whether classified information had been improperly disclosed.

Hur ultimately declined to bring criminal charges, concluding that prosecutors would likely have difficulty convincing a jury that Biden intentionally violated the law.

However, Hur's report drew widespread attention after describing Biden as "a sympathetic, well-meaning, elderly man with a poor memory" and noting that the former president sometimes appeared "painfully slow" during interviews.
