FBI Seizes iPhone and MacBook From Former Rep. Eric Swalwell, D-Calif., As Sexual Misconduct Probe Escalates

Federal investigators have crossed a consequential legal threshold in their investigation of former Rep. Eric Swalwell, D-Calif., seizing his iPhone and MacBook at San Francisco International Airport before searching his Washington, D.C., residence the following day.

A document filed in federal court states that agents seized the devices on the evening of August 15 and provided Swalwell with a copy of the warrant. The supporting records remain sealed, leaving the evidence presented to the court—and the precise scope of the authorized searches—outside public view. San Francisco Chronicle.

Agents reportedly executed a separate warrant at Swalwell’s Washington home on August 16. The searches are part of an ongoing federal investigation involving sexual-misconduct allegations, which Swalwell has denied.

The question now is not simply what agents took, but what they told a judicial officer to obtain permission to take it.

The Fourth Amendment requires warrants to be supported by probable cause and to particularly describe the location to be searched and the property to be seized. Under Federal Rule of Criminal Procedure 41, a magistrate judge may issue a warrant after reviewing an affidavit or sworn information establishing probable cause to search for and seize evidence.

That means investigators needed more than a generalized allegation against Swalwell. They had to establish a factual connection between suspected criminal conduct and the particular devices or residence targeted.

Electronic devices can contain messages, photographs, emails, calendars, location information and metadata. However, the sealed warrant determines which categories of information agents may lawfully examine. Seizing a device does not automatically authorize an unrestricted search of everything stored on it.

Nor does the warrant mean a judge determined that Swalwell committed a crime. Probable cause is an investigative standard—not the beyond-a-reasonable-doubt standard required for conviction. Swalwell has not been convicted, and no public indictment has resulted from the searches.

One possible federal theory involves 18 U.S.C. § 242, which criminalizes the willful deprivation of federally protected rights under color of law. Former federal prosecutor Andrew Weissmann told NPR that the statute can apply when a federal official allegedly abuses governmental authority to engage in sexual misconduct.

But merely holding public office is not enough. The government would have to prove that the accused used, invoked or misused official authority—not simply that alleged conduct occurred while the person happened to be a government official. The Justice Department identifies three core elements: deprivation of a federal right, willful conduct and action under color of law.

State authorities may ultimately play a larger role. New York and Los Angeles-area agencies have opened investigations into separate allegations involving Swalwell. If federal investigators uncover evidence more directly supporting state offenses, that material could potentially be shared with the appropriate local prosecutors through lawful investigative channels.

For now, the warrants show that investigators persuaded judicial officers there was a lawful basis to search for specified evidence. What that evidence reveals—and whether prosecutors can transform it into admissible proof—remains unresolved.
