Senators File Ethics Complaint Against Third Circuit Judge Jennifer Mascott Over Role At PR Firm

Two Delaware senators have formally asked the federal judiciary to examine an unusual question: How much of a private company can a federal appellate judge actually run while simultaneously doing the public's work from the bench?

Sens. Chris Coons and Lisa Blunt Rochester, both Democrats, filed a complaint under the Judicial Conduct and Disability Act against U.S. Circuit Judge Jennifer Mascott, a Trump appointee who joined the Third Circuit last year. The complaint, dated Oct. 2 and made public Tuesday, was submitted to Third Circuit Executive Margaret Wiegand. Senator Christopher Coons

The accusation sounds straightforward at first. It isn't.

Mascott inherited a 100% ownership interest in Adfero, the Washington public affairs firm founded by her late husband, Jeff Mascott, after his death in 2023. She disclosed that financial interest during her confirmation process. The senators expressly acknowledge that simply owning the company was not necessarily unethical.

The harder question is what she allegedly did with it.

Politico reported in August, based on interviews with 14 former employees and clients, that Mascott remained deeply involved in Adfero after receiving her judicial commission on Oct. 10, 2025. Nine former employees said she worked from its Washington office at least once a week and participated in staffing, business development and client relations. The firm ultimately closed June 30. Currently

Mascott has disputed the suggestion that she crossed an ethical line. She said she acted as managing trustee pursuant to her late husband's wishes, remained transparent with appropriate authorities and routinely consulted the firm's lawyers, advisers and ethics experts about her obligations.

That defense matters because the judicial code contains an exception that makes this case far more interesting than a simple "judge had a second job" story.

Canon 4 permits a judge to serve as a manager, officer, director or employee of a business when it is closely held and controlled by the judge's family. But the official commentary adds an important boundary: even participation in a family business can become impermissible when it consumes too much time, misuses judicial prestige or creates conflicts with matters likely to reach the judge's court. United States Courts

In other words, the real fight may not be over whether Mascott was allowed to touch Adfero. She apparently was. The issue is how much she was doing and what kind of work she was directing.

The senators point to another concern. According to Politico's reporting, Mascott brought in consultants with Republican political ties as Adfero lost employees, while former clients said the historically bipartisan firm appeared to be moving in a more partisan direction. The complaint argues that this could implicate Canon 5's restrictions on political activity, particularly because Adfero's work included communications designed to influence elected officials. Senator Christopher Coons

Coons and Blunt Rochester also note that Mascott has authored only three written opinions in precedential matters since taking the bench, two roughly a page long, and question whether her outside work affected her judicial workload. But even the senators concede that comparison has limits: appellate work extends far beyond published opinions, and outsiders do not know precisely how cases and writing assignments were divided among Third Circuit judges.

That makes the business-management evidence more important than simply counting opinions.

And a complaint is not a finding of wrongdoing. Under federal judiciary rules, Chief Judge Michael Chagares can conduct a limited inquiry, dismiss or conclude the complaint, or appoint a special committee of judges to investigate. A judicial council can ultimately impose measures ranging from a reprimand to restrictions on new case assignments. An Article III judge, however, cannot simply be fired through this process; removal ultimately requires congressional impeachment. United States Courts

That is why Mascott's case could matter beyond one judge or one defunct PR firm. Federal ethics rules clearly recognize that judges can still own property, investments and family businesses. What this complaint asks the Third Circuit to define is the point at which protecting a family asset turns into actively running a second enterprise while holding a lifetime federal judicial commission.
