Bayer’s years-long effort to contain the massive litigation surrounding Roundup is approaching one of its most consequential moments.

On Monday, Sept. 14, Circuit Judge Timothy J. Boyer in St. Louis will consider whether to grant final approval to a nationwide class-action settlement requiring Bayer-owned Monsanto to provide up to $7.25 billion to resolve current and future claims alleging exposure to Roundup caused non-Hodgkin lymphoma, or NHL. A ruling is not necessarily expected from the bench.

The hearing comes as Bayer faces approximately 65,000 Roundup claims in state and federal courts. The litigation has followed the company since its $63 billion acquisition of Monsanto in 2018 and has already produced billions of dollars in settlements, verdicts and legal expenses.

Unlike an ordinary one-time mass-tort settlement, this agreement attempts to create a system for people who are already sick and people who may develop NHL years from now.

Monsanto would fund the program over approximately 17 to 21 years. Compensation generally would depend on whether exposure occurred occupationally or residentially, the claimant’s age at diagnosis and whether the NHL is classified as aggressive or indolent. Court-filed settlement materials describe average program awards ranging from approximately $10,000 to $165,000, with certain quick-pay claims beginning at $6,000.

That long reach is also where some of the controversy begins.

Class members who remain in the settlement surrender significant litigation rights involving Roundup exposure. The court-authorized notice states that participating members generally give up independent claims for compensatory damages, medical monitoring and punitive damages. People diagnosed in the future must first go through the settlement claims process before potentially exiting under specified conditions.

Lawyers opposing the agreement contend those restrictions can effectively funnel present and future cancer victims into a compensation structure that may pay substantially less than a successful jury verdict.

Settlement supporters counter that courtroom outcomes have become far less predictable—and that a guaranteed, funded compensation program may be preferable to years of expensive litigation.

That uncertainty increased dramatically in June when the U.S. Supreme Court ruled for Monsanto in Monsanto Co. v. Durnell.

In a 7-2 decision, the Court held that the Federal Insecticide, Fungicide, and Rodenticide Act preempted Durnell’s Missouri failure-to-warn claim because it would effectively require Monsanto to add a cancer warning that EPA-approved labeling did not require.

The Court concluded that such a state requirement would be “in addition to” or “different from” Monsanto’s federal labeling obligations.

That decision does not automatically eliminate every Roundup theory of liability, but it significantly weakened a central warning-label theory used in many cases and strengthened Monsanto’s negotiating position.

The Scientific Dispute Remains

The underlying cancer question remains heavily disputed.

The International Agency for Research on Cancer classified glyphosate, Roundup’s principal active ingredient, as “probably carcinogenic to humans” in 2015.

The EPA reached a different conclusion, finding glyphosate “not likely to be carcinogenic to humans” under expected real-world exposures. EPA is conducting an updated human-health risk assessment expected later in 2026.

Monsanto continues to deny that Roundup causes cancer and is not admitting liability through the proposed settlement.

For Bayer, Monday’s hearing is therefore about more than approving billions of dollars in payments. It is an attempt to create something the company has struggled to obtain for years—legal finality.

For cancer claimants, however, Judge Boyer must answer a different question: whether that finality is being purchased on terms that are fair, reasonable and adequate for the people giving up their right to continue fighting in court.
