CoStar’s Copyright Fight With Zillow Puts Real-Estate Photos—and Platform Power—Under the Law

If you’ve ever scrolled through home photos on Zillow, this new lawsuit says a lot of those pictures shouldn’t have been there. CoStar Group—the company behind Homes.com and Apartments.com—just took Zillow to federal court, accusing it of using nearly 47,000 copyrighted photos to juice its rental business and then piping many of those images to rival sites through syndication. At stake isn’t just who owns a picture—it’s who controls the data and media that power modern real-estate platforms.

What CoStar Alleges—and Why It Matters

Filed July 30 in the Southern District of New York (CoStar Group Inc. et al. v. Zillow Group Inc. et al., No. 25-06248), the complaint says Zillow displayed CoStar photos “to bolster its online rental listings business,” sometimes even with CoStar watermarks visible, and distributed them to Redfin and Realtor.com via syndication. CoStar is seeking compensatory and punitive damages it says could exceed $1 billion.

The complaint itself uses strong language, seeking to “redress Zillow’s widespread and systematic infringement” of CoStar’s copyrighted images. CoStar adds that its team has identified 46,979 specific photos so far and says many were reused 250,000+ times across pages. Fox Business

CoStar’s CEO Andy Florance called the alleged conduct “nothing short of outrageous,” adding that Zillow is “profiting from decades of CoStar Group work.” He also warned he would sue Redfin and Realtor.com if CoStar photos aren’t removed from those platforms. investors.costargroup.com

Zillow had not issued a detailed comment on the CoStar suit at the time of the filings reported.

The Bigger Picture: Platform Power and Photo Rights

Why should everyday readers care? Because visuals sell homes and rentals—and whoever controls those visuals controls attention, leads, and revenue. CoStar says it has invested billions and hired thousands of photographers to build a massive library of real-estate images. If those assets can be copied or widely re-used without permission, it erodes the incentive to create and license high-quality media—and it can shift competitive advantage overnight.

This isn’t Zillow’s first photo-rights fight. In a long-running dispute with VHT Studios, courts ultimately ordered Zillow to pay roughly $1.9 million in 2022 for infringement connected to its “Digs” section—after years of litigation and appeals. A Second Legal Front: Compass v. Zillow

CoStar’s case lands as Zillow faces a separate June lawsuit from Compass, the country’s largest residential brokerage by sales volume. Compass alleges Zillow’s new policy—dubbed by Compass as the “Zillow Ban”—unlawfully restricts listings that appear elsewhere first, harming competition and consumer choice. Zillow’s audience and scale are enormous: an estimated 160 million homes in its database and 2.4 billion visits in Q1 2025 alone—numbers that explain why control of images and listings on the platform is so contentious.

What Happens Next—and What It Means For You

  • For photographers/creators: Keep tight licenses, watermark policies, and DMCA takedown strategies. Lawsuits like this reinforce that clear chain-of-title and explicit platform permissions matter.
  • For landlords/property managers/agents: Verify you have rights to every photo you upload or reuse—especially if content came from a prior listing service or vendor.
  • For consumers: The outcome could affect what photos you see, where you see them, and how quickly listings syndicate across portals. If courts curb reuse, some pages could look leaner—but creators would be better protected.
