Fallout Grows After State Bar of California Admits Using A.I. to Draft Bar Exam Questions

CALIFORNIA - The legal community is reeling after the State Bar of California dropped a bombshell revelation: artificial intelligence helped author multiple-choice questions for the February 2025 bar exam.

Coming at a time when judges across the nation are admonishing lawyers for improperly using A.I. in courtrooms, this disclosure has many questioning whether the Bar—the so-called guardian of legal competence—is now itself relying on tools it warns others about.

But the firestorm doesn't end there. Critics say the A.I. controversy is just the tip of the iceberg. Beneath the surface, accusations are mounting that the State Bar’s controversial Diversity, Equity, and Inclusion (DEI) initiatives are systematically disadvantaging white male applicants, creating what some call a modern-day "gatekeeping" scheme in the name of diversity.

The Great Bar Exam Debacle

Problems with the February 2025 bar exam were apparent from the start. Hundreds of applicants reported technical meltdowns: crashes before tests even began, screen freezes, disappearing essays, and devastating lags that prevented completion.

But what wasn’t immediately known is what made this exam different. In a shocking admission this week, the State Bar revealed that 23 of the scored multiple-choice questions were created by ACS Ventures, its hired psychometrician, using artificial intelligence.

Leah Wilson, the State Bar’s executive director, issued a statement attempting to contain the fallout:

“We have confidence in the validity of the [multiple-choice questions] to accurately and fairly assess the legal competence of test-takers.”

Yet confidence in the Bar itself is rapidly eroding. Mary Basick, assistant dean at UC Irvine Law School said,

“The debacle that was the February 2025 bar exam is worse than we imagined,” Mary Basick, assistant dean of academic skills at the UC Irvine Law School said. “I’m almost speechless. Having the questions drafted by non-lawyers using artificial intelligence is just unbelievable.”

Katie Moran, a professor at the University of San Francisco School of Law, echoed the alarm: “It’s a staggering admission.”

“The State Bar has admitted they employed a company to have a non-lawyer use A.I. to draft questions that were given on the actual bar exam,” she said. “They then paid that same company to assess and ultimately approve of the questions on the exam, including the questions the company authored.”

In essence, the gatekeeping institution tasked with ensuring lawyers are qualified is now being accused of lowering the standards—by turning to outsourced non-lawyer A.I. developers to write the very tests that license the profession.

It gets worse: according to the State Bar's own admission, Kaplan drafted 100 of the 171 scored multiple-choice questions, and 48 more were recycled from a first-year law students’ exam. Only a minority came directly from traditional lawyer-drafted sources.

The DEI Fallout: Allegations of Discrimination

For many, this A.I. scandal is intertwined with a broader, more sinister accusation: that the State Bar’s DEI-driven policies are unlawfully discriminating against white and Caucasian men.

In online forums, legal blogs, and independent reports, there’s growing outrage. Some allege that the State Bar’s diversity initiatives have quietly morphed into policies designed to reject a disproportionate number of white male applicants—citing novel "competency scoring systems," "subjective performance reviews," and questionable “moral character evaluations.”

Civil rights attorneys are calling for federal investigations into whether the Bar’s conduct violates Title VII of the Civil Rights Act and equal protection guarantees under the Constitution.

One civil rights expert, who asked to remain anonymous, told USA Herald:

"The State Bar cannot claim to be neutral while adopting policies that create disparate impacts against protected groups. If true, these allegations expose them to serious civil rights litigation."

Bigger Questions About the Bar’s Relevance

All of this feeds into a growing existential question:
Is the State Bar of California losing its legitimacy?

Once revered as the ultimate arbiter of legal readiness, the Bar now faces a perception crisis. Many in the legal community, particularly younger lawyers and law students, see the Bar less as a symbol of competence and more as a "glorified gatekeeping club", one that selectively admits only those who align with its ideological and political preferences.

Moreover, A.I.'s growing role in the legal industry is blurring old lines. If lawyers must now master the responsible use of artificial intelligence to compete in the modern market, how can the Bar simultaneously punish and rely on the very same tools?

As one legal commentator put it bluntly:

"When the licensing exam is written by A.I. and judged by activists, you no longer have a meritocracy—you have a rigged system."

What’s Next?

The next bar exam is scheduled for July 29-30, 2025, at San Diego’s Sheraton Mission Valley and Chula Vista Elite Athlete Training Center.

But confidence in the process has never been lower.
Many applicants are asking:

  • Will A.I. draft those questions too?
  • Will politics continue to overshadow merit?
  • Is the Bar exam still a meaningful measure of readiness—or just another political test?

The California Supreme Court will soon weigh in on whether to adjust February scores, but the real question may be whether the Court can—or will—restore public trust in the State Bar at all.
