A lawsuit was officially filed in the U.S. District Court for the Southern District of New York on September 19, 2023. The Authors Guild is suing OpenAI in a bid to safeguard its members. The battle over copyright could potentially reshape the landscape of intellectual property rights protections in the age of generative AI.

The coalition of 17 high-profile authors and screenwriters has initiated a class-action lawsuit against OpenAI. Spearheaded by the Authors Guild, a prestigious professional organization representing published writers, this lawsuit has ignited a fierce debate in the world of AI and intellectual property.

The heart of the authors' allegations lies in the claim that OpenAI's ChatGPT, an advanced artificial intelligence bot, engaged in unlawful replication of their copyrighted works.

Battle over Copyright: Lawsuit

In a press release issued by the Authors Guild, they claim that "Generative AI threatens to decimate the author profession." 

“It is imperative that we stop this theft in its tracks, or we will destroy our incredible literary culture, which feeds many other creative industries in the US,” Authors Guild CEO Mary Rasenberger explained in the release.

 “Great books are generally written by those who spend their careers and, indeed, their lives, learning and perfecting their crafts. To preserve our literature, authors must have the ability to control if and how their works are used by generative AI,” she added.

The lawsuit contends that books penned by these authors were illicitly downloaded and utilized to train GPT systems. Consequently, OpenAI stands accused of potentially profiting from creating new works in the distinctive styles of these authors, all while the original creators are left with nothing.

The press release highlights AI's bold and risky endeavors, including efforts to craft two additional volumes within George R.R. Martin's iconic Game of Thrones series and AI-generated books available for purchase on Amazon. 

The authors are not only seeking an injunction to prevent OpenAI from employing their works for ChatGPT's training but are also demanding unspecified monetary damages. 

Notably, the complaint references a lawsuit against OpenAI, where Sarah Silverman and two other authors sued the company for similar copyright infringement.

The list of named plaintiffs in this landmark lawsuit against OpenAI reads like a who's who of the literary world. It includes best-selling authors such as David Baldacci, Mary Bly, Michael Connelly, Sylvia Day, Jonathan Franzen, John Grisham, Elin Hilderbrand, Christina Baker Kline, Maya Shanbhag Lang, Victor LaValle, George R.R. Martin, Jodi Picoult, Douglas Preston, Roxana Robinson, George Saunders, Scott Turow, and Rachel Vail.

Writers want protection

The controversy surrounding AI's impact on the creative realm has spilled over into legislative discussions.

 During a Senate subcommittee hearing, Mary Rasenberger, CEO of the Authors Guild, advocated for the creation of legislation that would protect writers from AI's encroachment. 

She specifically called for rules mandating transparency from AI companies regarding their model training processes. Additionally, over 10,000 authors, including luminaries like James Patterson, Roxane Gay, and Margaret Atwood, signed an open letter. 

The letter called upon AI industry leaders, including Microsoft and OpenAI, to obtain authors' consent when utilizing their work for AI training and to ensure fair compensation for such use.

One of the contentious issues at the heart of the matter is the legality of data collection by generative AI models like ChatGPT. These AI systems rely on amassing vast datasets from the internet to inform their responses to a multitude of inquiries. 

However, this massive data collection transpires without explicit permission, raising significant legal questions. 

If OpenAI is found to have violated copyrights during this data collection process, federal law permits the destruction of the infringing materials upon the conclusion of the legal proceedings.

Federal copyright law carries substantial financial penalties for those guilty of willful infringement. These penalties can reach as high as $150,000 for each infringement. This serves as a formidable legal threat that looms over AI companies. And underscores the need to define the technology and negotiate solutions in this contentious arena.

As this legal battle unfolds, it holds the potential to set precedents and define the boundaries of copyright protection in an era dominated by artificial intelligence and generative models.
