Uber $8.5M Bellwether Verdict

The Uber $8.5M Bellwether Verdict has landed like a thunderclap in sprawling multidistrict litigation over alleged driver sexual assaults — and attorneys say one key jury finding may echo far beyond a single courtroom.

After a three-week trial and roughly 12 hours of deliberations, an Arizona federal jury on Feb. 5 ordered Uber Technologies Inc. to pay $8.5 million in compensatory damages to a woman who said she was sexually assaulted by a driver in 2023.

The jury stopped short of awarding punitive damages and declined to find Uber negligent regarding rider safety. Still, it held the company liable under a different and potentially far-reaching theory: that the driver acted as Uber’s “apparent agent.”

The damages award was far below the $144 million in compensatory and punitive damages the plaintiff had sought. But legal observers say the implications may loom much larger than the dollar figure suggests.

A Pivotal Theory: Apparent Agency

The multidistrict litigation — consolidating more than 3,100 cases — alleges Uber has known since 2014 that some drivers using its platform sexually assaulted passengers and failed to implement stronger safety measures, including in-app cameras and more rigorous background checks.

Deepak Gupta of Gupta Wessler LLP called the verdict historic.

“By any measure, this is a landmark verdict,” Gupta said, noting it marks the first time a rideshare platform has been held responsible in this MDL, one of the most closely watched mass tort proceedings in the country.

Gupta emphasized the jury’s apparent agency finding — a doctrine under which a company may be held liable if a worker appears to act on its behalf — could serve as a blueprint for future trials.

“Not many observers were focused on that theory,” he said. “But plaintiffs have multiple arrows in their quiver.”

In practical terms, he added, the verdict signals that juries may be willing to look past Uber’s long-standing argument that its drivers are independent contractors and instead scrutinize how the company structures and oversees its platform.

“It means a federal jury was willing to cut through technicalities,” Gupta said. “That should get attention in corporate boardrooms.”

Ripple Effects Beyond the Courtroom

The implications could extend well beyond the 3,100-case MDL.

Aaron Davis of Davis Goldman PLLC, who sues rideshare companies on behalf of injured plaintiffs, said the apparent agency ruling may influence auto collision cases often steered into private arbitration.

“Uber and Lyft try to require that auto accident claims be arbitrated,” Davis said. “Once you’re in arbitration, proving apparent agency becomes much harder.”

The verdict, he suggested, could reshape that calculus. Plaintiffs historically wary of arbitration — where vicarious liability claims can stall — may now see new leverage.

“Whereas it used to be that you don’t want to arbitrate because you may end up with no vicarious liability, this verdict may change the game,” Davis said.

Settlement Calculus Begins

Gupta said the outcome strengthens the argument that Uber may need to consider a broader resolution strategy, including a potential global settlement.

Mass tort litigation, he said, is designed for precisely this kind of dispute — where companywide evidence about foreseeability, internal knowledge and safety practices can be applied across thousands of claims.

“People do find ways to reach global resolutions,” Gupta said. “The system is capable of that.”

Alexandra Lahav, a tort scholar at Cornell Law School, described the verdict as a meaningful data point — but not a final answer.

“The trial was meant to test claims and defenses,” she said. “It’s useful information that the parties will likely use in negotiating a global settlement.”

Still, Lahav cautioned that the MDL remains in early innings. She pointed to a separate California state case in September where a jury cleared Uber, finding its alleged negligence was not a substantial factor in a passenger’s assault.

“There have been two trials so far, and they’ve gone different ways,” she said. “It’s likely the parties will need to litigate further before reaching any aggregate settlement.”

“It’s an important victory,” she added, “but it isn’t the end.”

Next Trial on the Horizon

The litigation machine is already grinding toward its next test. Jury selection in the second bellwether trial is scheduled to begin April 13 in North Carolina federal court, according to court records.

Like the first, that proceeding may serve as another weather vane for how juries interpret Uber’s responsibilities — and how much liability may ultimately attach to the platform.

For now, the Uber $8.5M Bellwether Verdict stands as both milestone and warning shot: a single case in a sea of thousands, but one capable of reshaping the tides.
