Amidst a surging tide of skepticism, the New York City Bar Association (NYCBA) has cast its gaze on Congress, beseeching swift action to restore confidence in the Supreme Court – if the court itself doesn't tighten its reins.

"In these tumultuous times, our bedrock of trust is the judicial system," stated NYCBA President Susan Kohlmann. "This Senate bill could be the lighthouse guiding the Supreme Court back to its esteemed position in the public's eyes."

New York City Bar Association: The Spotlight on SCERT Act

On Monday, the NYCBA fervently backed Senate Bill 359, dubbed the Supreme Court Ethics, Recusal and Transparency Act (SCERT Act), a brainchild of Sen. Sheldon Whitehouse.

This act isn't just a piece of paper but a clarion call for accountability.

If transformed into law, the SCERT Act mandates the Supreme Court to:

• Formulate a code of conduct within 180 days of the law's passage.
• Ensure justices step back from cases if they, or their families, received benefits from involved parties in the last six years.
• Establish robust systems for lodging and scrutinizing complaints against justices.

 Lavish Gifts and Missing Disclosures: A Web of Doubts

Gifts, vacations, undisclosed real estate deals – recent revelations have painted some justices in shades of gray.

Last week's spotlight on Justice Clarence Thomas, regarding unreported luxury gifts, has intensified calls for external oversight.

Kohlmann remarked, "The increasing waves of concerns aren't just about one shocking revelation; it's the accumulation that's distressing.

There's an urgent need for a mechanism to sift through allegations and ensure utmost propriety."

 Book Deals and Financial Disclosures: Where's the Line?

Justice Ketanji Brown Jackson's upcoming memoir deal and recent book publications by Justices Amy Coney Barrett, Neil Gorsuch, and Sonia Sotomayor have further muddied the waters.

The big numbers in their royalties, disclosed last year, have left many eyebrows raised.

With plummeting approval ratings, Kohlmann believes these multifaceted actions are chiseling away at the foundational trust in the judiciary.

New York City Bar Association: A Crisis of Confidence

The NYCBA decries the void of a genuine investigation process, causing severe tarnishing of the court's reputation.

Their strong words resonate with urgency, emphasizing the court's apparent inertia in addressing this growing trust deficit.

Although members of the court claim to be their own best watchdogs, Kohlmann counters this, highlighting the Chief Justice's reluctance to even converse on the issue.

"The court's inaction isn't just passive; it's actively corroding public respect," she stated. "Denying an ethical code and transparency means the public is in the dark about those who hold life-tenured judicial positions."

 Strengthening the Oversight Mechanism

NYCBA's call to action is clear: amplify the existing financial disclosure standards, and erect a fortified accountability framework.

The association lauds the SCERT Act's provisions – from drafting conduct codes to complaint redressal mechanisms.

Kohlmann's passionate plea: "Every legal mind should rally behind this. Our foremost desire? Restoring unwavering faith in our institutions."

As the storm of concern swirls, all eyes turn to Congress and the Supreme Court, awaiting their response.
