EPA Unveils New Water Rule Amidst Legal Tornado

EPA unveils new water rule

In a move as intricate as a surgeon's touch, the Biden administration unveiled a restructured water rule on Tuesday, reshaping the terrain of federal jurisdiction under the Clean Water Act (CWA).

This audacious pivot comes hot on the heels of a U.S. Supreme Court judgment earlier this year which essentially trimmed the expansive wings of the federal government's jurisdiction over the nation's waters.

Wetlands' Role in the National Waterscape Reimagined

It's a bit like redefining borders on a map; the U.S. Environmental Protection Agency (EPA) and the Army Corps of Engineers presented their new conclusive rule.

This policy sidestepped the customary public discourse, setting a fresh benchmark for wetlands' classification under the CWA.

Remember the Sackett v. EPA verdict from May? The apex court clipped the wings of the former, more generous interpretation, putting a tighter leash on the wetlands dubbed as "waters of the U.S."

Picturing wetlands now is like envisaging select VIPs at an elite club. To be considered WOTUS or under jurisdiction, they must mirror "relatively permanent, standing or continuously flowing bodies of water," that also boast an unbroken surface liaison with bodies considered as "waters of the United States."

EPA Unveils New Water Rule : Narrowing the Playing Field

Streams find their reach curtailed and the waters deemed as "adjacent" wetlands have a tighter boundary.

The outcome? A swathe of wetlands, formerly swaddled in the CWA’s protective embrace, now find themselves on the outside looking in.

EPA's top gun, Administrator Michael Regan, voiced his dissent on the Sackett ruling, stating, "While I am disappointed by the Supreme Court's decision in the Sackett case, EPA and Army have a responsibility to align with our state co-regulators, tribes and partners."

Delving into history, the EPA and Army Corps had earlier banked on the "relatively permanent" yardstick, a vision shared by former Justice Antonin Scalia in 2006's Rapanos v. United States.

They had also leaned on former Justice Anthony Kennedy's perspective from the same case, which threaded wetlands with the Clean Water Act if they bore a "significant nexus" to another WOTUS.

Yet, the Sackett case saw a major twist. Five justices deemed Kennedy's perspective non-compliant.

Consequently, in June, agencies hinted at a forthcoming rule, echoing the Supreme Court's sentiments.

The Evolution of the "Adjacent" Definition

Before, "adjacent" wetlands were visualized as those "bordering, contiguous, or neighboring ... [or] separated from other 'waters of the United States' by man-made barriers, natural berms, or dunes." Now? It simply translates to "having a continuous surface connection."

Why the rush without public scrutiny? The agencies cite "good cause" under the Administrative Procedure Act to speed things up, as their tweaks post-Sackett "do not involve the exercise of the agencies' discretion," sparing the regulated community any burdens.

However, the initial rule version from January faced a storm of litigation. Courts halted its implementation in 27 states. With cases pending in Texas, North Dakota, and the Sixth Circuit, all eyes remain riveted on the ripple effects of this freshly-minted rule.
