In a riveting session at Stockton University, U.S. District Judge Esther Salas, backed by prominent New Jersey legal figures, emphasized the need for increased implementation of Daniel's Law, an often-overlooked New Jersey statute, to better protect personal information of judges and other legal professionals online.

Judge Salas NJ Law : A Mother’s Tragic Loss Spurs Legal Action

Daniel's Law, christened after Judge Salas' son, Daniel Anderl, who met a tragic end in 2020, targeted by a shooter at their family home, offers provisions to mask details like home addresses for those in the judiciary. Despite its importance, startling data from the state's Office of Information Privacy reveals that a mere 8,000 out of 15,000 eligible individuals have embraced its protective measures.

Salas described both Daniel's Law and its federal counterpart as "a solid step." However, she emphasized the paramount importance of personal responsibility, stating, "it also is going to take personal accountability from every individual that is at risk."

An Open Panel Discussion

The William J. Hughes Center for Public Policy at Stockton University hosted the event, featuring insights from Judge Salas, New Jersey State Bar Association's president, Timothy McGoughran; OIP director, Christine Campbell; and retired assignment judge, Julio Mendez.

It's no secret that Judge Salas has been at the forefront, advocating for enhanced judicial security and privacy. This crusade stems from a harrowing 2020 incident where an anti-feminist lawyer, having a case under her, targeted and shot her 20-year-old son, Daniel, and severely injured her husband, leveraging publicly accessible information.

Drawing a chilling analogy, Salas remarked, "This open-source information is the ammunition that can be used to target us and to kill us." The tragedy ignited her pursuit for the establishment of Daniel's Law and the federal Daniel Anderl Judicial Security and Privacy Act, ratified by Congress in December 2022.

 Addressing the Shortcomings and the Skeptics

However, these laws solely cover government databases. Campbell addressed a growing concern: is the redaction process worth the effort if information remains on non-governmental sites? She ardently responded that data brokers primarily source from governmental sites, reinforcing the urgency to redact personal data there.

The virtual world's vast expanse and its evolving role in jeopardizing personal information isn't lost on Campbell, who declared, "We have to get ahold of this."

While McGoughran underscored the lawyers' pivotal role in ensuring a secure judiciary, he also spotlighted municipal judges' vulnerability, considering their higher visibility and typically less secure working environments.

However, every coin has two sides. Daniel's Law and the push for enhanced judicial privacy have faced criticism. Advocates for governmental transparency argue that certain information should remain public to uphold ethical standards. But Judge Salas, while advocating for legal transparency, also underlined the crucial difference between transparency and avoidable risk.

The judicial arena is at a crossroads, striving to balance openness with security in a digital age where personal data can be both a tool and a weapon.
