Congress Litigation Ethics

A gripping Congressional hearing unfolded on Wednesday, as lawmakers convened to deliberate the ethical dimensions of litigation funding. The proceedings were fraught with tension as partisan divisions cleaved through the heart of the debate. Republicans, adamant in their condemnation, decried the multibillion-dollar litigation funding industry as a burden on businesses and even a potential national security menace. Meanwhile, Democrats largely brushed off the issue, pivoting to call for an inquiry into recent ethical scandals at the Supreme Court.

Congress Litigation Ethics : Divided Lines in Heated Oversight Hearing

The House Committee on Oversight and Accountability orchestrated a marathon session lasting approximately four and a half hours. During this time, committee members took turns either grilling or tossing softballs at five witnesses summoned to dissect third-party litigation funders and their purportedly "abusive litigation tactics," as indicated in committee memos.

The panel of witnesses included two law school professors, industry representatives from offshore oil and gas and mining sectors, and Aviva Wein, assistant general counsel at pharmaceutical juggernaut Johnson & Johnson.

Explosive Growth and Ethical Quandaries

The contentious focal point of the hearing centered on third-party litigation funding, a burgeoning industry that bolsters plaintiffs by financing legal battles they might otherwise be unable to afford. Over the past two decades, this sector has skyrocketed, boasting a staggering $13.5 billion in assets under management last year, according to a February report.

Committee Chairman Congressman James Comer, R-Ky., acknowledged the necessity of litigation funding for some plaintiffs but voiced deep concerns about the "untraceable and undisclosed funding of lawsuits" that he believes raises significant ethical and legal questions. He added, "Many lawsuits are funded by progressive activists or private equity seeking to hijack America's legal system to implement their policy desires or make a quick buck."

Republicans Unearth Alleged Tactics

Republican representatives expended a substantial portion of their time dissecting various alleged machinations within the litigation funding realm. One practice singled out for censure was "sue and settle" tactics, where organizations, often environmental groups, litigate executive branch agencies like the U.S. Environmental Protection Agency to establish stricter environmental regulations.

Rep. Lauren Boebert, R-Colo., lambasted these tactics as a "constant wave of litigation by environmental extremists," contending that they not only undermine American businesses but also vest excessive power in environmental groups.

Additional concerns were voiced regarding foreign adversaries, such as Russia and China, possibly manipulating litigation funders to finance lawsuits against American corporations or defense contractors. This strategy could grant them access to sensitive information for military espionage or to cripple American firms' competitive edge.

To illustrate this point, Republican lawmakers cited the undisclosed $1.6 billion investment by an unnamed sovereign wealth fund into litigation funder Burford Capital.

Congress Litigation Ethics : American Industries Echo Concerns

Representatives from American industries echoed the concerns regarding litigation funding's impact on their operations. Aviva Wein, representing Johnson & Johnson, was joined by Erik Milito, President of the National Ocean Industries Association, and Julie C. Lucas, Executive Director of MiningMinnesota.

Milito and Lucas contended that litigation funding has birthed a slew of "frivolous" lawsuits, hindering efforts to reduce the carbon footprint for oil and gas companies and the provision of rare earth metals crucial for electric vehicle production. According to Milito, these lawsuits are counterproductive to the goals of activist groups.

Democratic Pushback and Supreme Court Focus

On the other side of the aisle, Democrats used their time to condemn their Republican counterparts, accusing them of defending large corporations. They downplayed the significance of litigation funding compared to other pressing issues.

Many Democrats suggested that if ethics within the judicial system were a true concern, the Oversight Committee should prioritize investigating recent ethical scandals at the Supreme Court. These scandals involved accusations of Justices Clarence Thomas and Samuel Alito receiving lavish personal gifts from influential billionaires without disclosure.

Kathleen Clark, a law professor at Washington University, the sole witness invited by the committee's Democratic minority, supported this stance. She noted, "While ethics issues do arise in the context of litigation funding, in my professional opinion, they are nowhere near the top of the list of significant ethics concerns facing our courts."

Congress Litigation Ethics  :A Tale of Two Parties

With the curtains closing on Wednesday's gripping hearing, partisan battle lines remained sharply drawn. Rep. Jamie Raskin, D-Md., the committee's ranking Democrat, characterized the Republican focus as "surprising and bizarre." He quipped, "The real problem is that giant corporations are harmed when Americans injured by toxic torts or environmental crimes receive contributions from donors to help them bring personal injury or class action lawsuits."

The proceedings reached a fever pitch as Democrats chastised Aviva Wein for representing Johnson & Johnson, given the company's involvement in significant lawsuits regarding tainted talc and the opioid epidemic. Rep. Raja Krishnamoorthi, D-Ill., warned Wein to consider the merits of these lawsuits carefully.

Wein, in her defense, emphasized that the issue isn't about stifling aggrieved consumers or shielding companies from accountability. "In the current system," she concluded, "plaintiffs have become nothing more than pawns in the game structured by plaintiffs' counsel and litigation financiers to generate profits for themselves."
