Lawmakers Push for Bold Cannabis Reforms Ahead of Biden’s Exit

Congressional Democrats are intensifying their calls for President Joe Biden to harness his executive power in the final stretch of his presidency to make lasting changes to federal marijuana policies.

In a letter sent Monday, key lawmakers urged the president to build on the momentum of his past actions and take decisive steps toward cannabis reform, with a focus on additional pardons and broader regulatory changes. The letter, co-led by Sens. Elizabeth Warren (D-Mass.) and Ron Wyden (D-Ore.), along with Reps. Barbara Lee (D-Calif.), Earl Blumenauer (D-Ore.), and Ilhan Omar (D-Minn.), stresses that Biden must continue addressing the harms caused by outdated marijuana policies, particularly affecting marginalized communities.

Expanding Biden’s Legacy on Cannabis Reform

The Democrats’ plea comes after the president’s previous actions, including the initiation of a regulatory process that could lead to marijuana’s reclassification and a series of pardons for low-level marijuana offenses. While these actions were celebrated, lawmakers argue they are only the beginning.

“Rescheduling marijuana and granting pardons should not mark the conclusion of this administration’s historic efforts,” the letter states. “This is just the first step in using executive authority to undo the damage caused by decades of failed marijuana policy.”

A Push for Broader Clemency

The lawmakers are also calling on President Biden to expand his clemency efforts, urging him to take immediate action to address the disproportionate impact of marijuana convictions, particularly for those incarcerated for low-level offenses. The letter highlights a major gap in the president’s previous pardons: while announced with much fanfare, the pardons have not led to any immediate releases from prison. This is because most low-level marijuana offenses are prosecuted at the state and local levels, leaving federal clemency largely symbolic.

“The president should issue broader clemency, including another round of pardons and commutations to reduce sentences or end terms of incarceration,” the letter urges. “We also ask him to push state governors to expand marijuana clemency and decriminalize low-level marijuana offenses under state law.”

Reinstating the Cole Memo

Beyond clemency, the lawmakers recommend that the Department of Justice reinstate the Cole Memo, a policy crafted under the Obama administration to direct federal prosecutors to make cannabis-related cases a low enforcement priority in states that had legalized marijuana. The memo was rescinded in 2018 by then-Attorney General Jeff Sessions, but Democrats argue its reinstatement could significantly reduce federal interference with state-regulated cannabis industries.

While the removal of the Cole Memo did not lead to an immediate increase in prosecutions of state-legal marijuana operations, federal law enforcement actions, such as seizures and raids, have continued to hurt businesses. The lawmakers are calling for new guidance that not only deprioritizes marijuana prosecutions but also explicitly targets the prevention of racial disparities in enforcement.

A Critical Moment for Reform

With the clock ticking on Biden’s presidency, Democratic lawmakers are seizing the moment to demand action. Their letter makes it clear: while progress has been made, there is still much to be done. In the final weeks of his term, President Biden has an opportunity to solidify his legacy as a champion of cannabis reform by issuing broad pardons, reinstating key policies like the Cole Memo, and continuing efforts to dismantle the harms of the War on Drugs.

The call to action has sparked intense discussion, but with the complexities of cannabis reform in mind, the coming weeks could see pivotal shifts in the national conversation surrounding marijuana policy.
