Judge Declares Mistrial in Weinstein Rape Trial

For the second time, a jury could not do what prosecutors asked of them. For the second time, Harvey Weinstein walked out of a Manhattan courtroom without a rape conviction on the charge that has proven the most elusive in the long, twisting legal saga of the disgraced Hollywood producer. And for the second time, the case that helped ignite a global reckoning with sexual power and abuse collapsed into the void of a hung jury.

Justice Curtis Farber of State Supreme Court in Manhattan declared a mistrial Friday afternoon after jurors deliberated for more than two days without reaching a verdict on the charge that Weinstein raped aspiring actress Jessica Mann in a Manhattan hotel room in 2013. Standing before a visibly exhausted jury, Farber said it was "quite clear" the panel was "hopelessly deadlocked."

"I don't see any reason to go further in deliberations," Farber told the jurors shortly after 1:15 p.m. "It's not meant to be a coercive process." He then dismissed them.

A Legal Odyssey With No End in Sight

The mistrial is the latest bewildering chapter in a case that has been tried, overturned, retried, deadlocked, and now declared a mistrial again — a legal labyrinth that has consumed nearly five years and produced more questions than closure.

Weinstein was first tried in New York in 2020 and convicted of raping Mann, receiving a 23-year prison sentence in what was hailed as a seismic victory for the #MeToo movement. That conviction was subsequently overturned on appeal. In a second trial last year, the jury deadlocked on the rape count involving Mann, and Justice Farber ordered yet another trial — the proceeding that collapsed again on Friday.

This third trial was structurally different from its predecessors in one critical respect: for the first time, prosecutors built their case around a single accuser, asking jurors to weigh Mann's testimony alone against Weinstein's denials, in a case with no physical evidence.

Mann's Account, Told for the Third Time

Over five grueling days of testimony, Mann took the stand and recounted her account for the third time in a courtroom. Her story has remained consistent across three trials: in 2013, she was visiting New York and had arranged a morning meal with friends and Weinstein. He arrived early and secured a hotel room over her objections. Once she accompanied him there, she testified, he injected his penis with medication to produce an erection — and then raped her.

It is a testimony that has now been heard by three separate juries. Two of those juries could not agree on whether to believe it.

From #MeToo Watershed to Legal Quicksand

When Weinstein's first New York conviction landed in 2020, it felt like a tectonic shift — proof that the #MeToo movement, which his exposure had helped catalyze years earlier, had achieved something durable and consequential. The images of the once-omnipotent Hollywood producer shuffling into court with a walker, then being led away in handcuffs to serve 23 years, seemed to close a chapter on an era of unchecked male power in entertainment.

The accusations against Weinstein nearly a decade ago had reverberated far beyond Hollywood, triggering a global wave of reckoning that swept scores of powerful men from positions of influence across industries. He became the symbol of a system — and the symbol of its potential dismantling.

But since those early trials, the cultural momentum has shifted. Public attention on the #MeToo movement has visibly waned. And Weinstein's legal story, rather than standing as a monument to accountability, has grown increasingly complicated, increasingly unresolved, and increasingly exhausting.

The Los Angeles Conviction Still Stands — For Now

Weinstein's legal exposure extends beyond New York. He was separately convicted of sexual assault in a Los Angeles case and sentenced to 16 years in prison there. He is currently appealing that conviction. Should that appeal succeed, the architecture of legal accountability built around one of Hollywood's most notorious figures would face further erosion.

What Comes Next: A Fourth Trial?

Friday's mistrial drops the decision squarely in the lap of Manhattan District Attorney Alvin L. Bragg: whether to pursue a fourth trial on the rape charge — a proceeding that would mark the most sustained prosecutorial effort against a single defendant on a single count in recent New York legal memory.

The case was first brought under Bragg's predecessor. Three juries have now wrestled with it. Two have failed to convict. The question of whether a fourth attempt would produce a different outcome — or simply another deadlock — now rests entirely with the district attorney's office.

For Jessica Mann, who has told her story in open court three times and will potentially be asked to do so again, the legal system's inability to reach a verdict is its own kind of verdict — one that the law, thus far, has refused to formally render.
