Not the Owner, Just a Tenant: Federal Court Halts Trump’s $400M White House Ballroom

Who actually owns the White House?

That question — not the marble, not the price tag, not even the ballroom itself — sits at the center of a legal fight that just delivered President Donald Trump one of the sharpest rebukes of his second term.

On Friday, a federal appeals court ordered the administration to halt above-ground construction on Trump's $400 million ballroom project, upholding a lower court's preliminary injunction and testing, once again, the outer limits of presidential authority over the building he temporarily occupies.

"Whether or not a massive ballroom should be constructed is for Congress to decide and is not a matter for Executive self-help," the panel's majority wrote.

A Tenant, Not an Owner

The three-judge panel split 2-1, but the majority's language left little room for ambiguity about what the White House is — and who it belongs to.

"Each President is a temporary tenant, not the owner, of the White House and its Executive Residence," the panel said. "The President has no — and claims no — constitutionally assigned authority over that property, which is designed and maintained for the use of all Presidents, current and future, and for the American people."

The ruling upholds a preliminary injunction won by the National Trust for Historic Preservation, which sued the administration last year after the East Wing — a structure standing since 1902 — was torn down to make way for the ballroom without congressional approval.

Trump had initially described the project as being built "near" the East Wing. It was demolished instead.

The Legal Fight So Far

A federal judge had already blocked above-ground construction on the ballroom twice, while permitting underground work — including a security complex — to continue. Friday's appellate ruling upholds that same distinction: no above-ground work without Congress's sign-off, but the underground build can proceed.

The court gave the administration 14 days before the order takes effect, a window designed to let the White House seek emergency relief from the Supreme Court — which Trump has already promised to do.

"This unjust decision must be overturned by the Supreme Court in its entirety," he wrote on social media, calling the ruling "horrendous" and "politically motivated." He pointed to the dissenting judge's opinion, which described the majority's order as "a blatant abuse of discretion," and claimed the military and Secret Service consider the ruling a national security threat.

The Money Question Behind the Marble

Trump has repeatedly framed the ballroom as a gift to the country — built ahead of schedule, under budget, and funded entirely by a coalition of private donors, not taxpayers.

But that framing has run into a complication of its own. Republicans have pushed to direct a slice of $1 billion in taxpayer funds toward Secret Service security upgrades tied to the project — a plan a federal budget watchdog rejected in May.

The administration's legal defense leans heavily on security, not aesthetics. Government lawyers have argued that the ballroom's underground complex is necessary to protect the White House from drones, ballistic missiles and biohazards, and that the broader project includes bomb shelters, medical facilities and what Trump described Friday as "top secret military facilities."

Trump has said the need for hardened security became more urgent after an assassination attempt at the White House Correspondents' Association dinner in April.

What the Court Did — and Didn't — Decide

The panel was careful to draw a line between the ballroom's merits and the legal question actually before it.

"[This ruling] has nothing at all to do with whether the proposed ballroom is desirable," the panel wrote, adding that the decision does not foreclose the possibility that the administration could ultimately build it. "What it does mean is that the Defendants may not do so during the district court's expeditious litigation without securing Congress's authorization, as the Constitution and laws require."

In other words: the court isn't saying no. It's saying not without Congress.

The National Trust, which first sued after the East Wing demolition, framed Friday's ruling as a defense of something larger than any single administration's plans.

"The White House, a global landmark that symbolizes American identity and the ideals of democracy, belongs to the American people," said Brent Leggs, President and CEO of the National Trust for Historic Preservation. "The National Trust for Historic Preservation and its partners are proud to defend this irreplaceable monument on behalf of all Americans."

A Fight Over More Than a Ballroom

Trump unveiled the ballroom plan in July 2025, and it would have marked the most significant structural alteration to the presidential residence in more than seven decades. Legal trouble followed almost as soon as the demolition crews arrived in October.

Now the project's fate rests on a question far older than this administration: how much authority a sitting president has over a house he does not own, was not the first to occupy, and will not be the last to leave.

The Supreme Court may soon have to answer it.
