NEW YORK — A federal judge has delivered a major setback to the Justice Department, allowing fired federal prosecutor Maurene Comey to move forward with her explosive lawsuit alleging she was targeted and removed because of her family ties and political associations. The ruling sets the stage for a closely watched legal battle over presidential power, civil service protections, and alleged political retaliation inside the DOJ.

The case, already drawing national attention, now advances into discovery, where internal government communications and decision-making could be scrutinized in detail. At its core is a question that could reshape how far executive authority extends over career federal prosecutors.

The dispute centers on Comey’s firing and what came next

Maurene Comey, a longtime assistant U.S. attorney in the Southern District of New York, was dismissed in July 2025 after nearly a decade of service. According to court filings, she received an email citing Article II of the Constitution as the basis for her termination, with no performance issues or misconduct identified.

Her lawsuit argues the firing was not routine personnel action but a politically motivated decision tied to her father, former FBI Director James Comey, a frequent target of Donald Trump’s criticism.

“Unlawful and unconstitutional” termination claim

In her complaint, Comey alleges she was removed “solely or substantially because her father is former FBI Director James B. Comey, or because of her perceived political affiliation and beliefs, or both.”

She also claims she was abruptly dismissed shortly after being asked to take on a major public corruption case, despite receiving strong performance reviews.

The Justice Department has denied wrongdoing and has argued the case should not proceed in federal court, but the judge rejected efforts to move it into administrative proceedings.

Court rejects DOJ effort to block lawsuit

Judge Jesse M. Furman ruled that Comey’s claims can proceed in federal court, finding that the dispute raises constitutional questions that cannot be handled solely through internal employment systems.

The decision allows Comey’s legal team to seek discovery, including communications from senior DOJ officials and potentially former leadership figures connected to the termination decision.

DOJ struggles over legal defense strategy

Court filings and reporting indicate internal complications within the Justice Department’s handling of the case, including office recusals and reassignment of responsibility to different U.S. attorney’s offices.

At one point, multiple offices reportedly declined involvement due to conflicts or other concerns before a new team was assigned to defend the government’s position.

Broader fight over presidential authority

The government has advanced a sweeping interpretation of Article II powers, arguing that presidential authority may allow removal of certain federal personnel even when political motivations are alleged.

Comey’s legal team calls that position an overreach, warning it could erode long-standing civil service protections designed to shield career prosecutors from political influence.

One of her attorneys described the government’s argument as “a novel and breathtaking theory about the scope of Article II power.”

High-profile context and political tensions

The lawsuit unfolds against a backdrop of heightened political conflict surrounding the Justice Department, including scrutiny of firings of career officials and ongoing disputes over prosecutorial independence.

Comey’s case has become a focal point in broader debates over whether federal employment protections can withstand direct executive pressure when politically sensitive cases or family connections are involved.
