The National Labor Relations Board (NLRB) has vehemently opposed the International Union of Operating Engineers (IUOE) Local 150’s attempt to impose sanctions against the agency. In a recent opposition brief, the NLRB challenged IUOE Local 150’s call for sanctions, asserting that the union cannot introduce arguments pertaining to the lawfulness of a punch-in policy for strike replacement workers. According to the NLRB, under Section 10(e) of the National Labor Relations Act, the union’s arguments regarding the legality of punch-in policy changes must have been presented before the NLRB.

The dispute traces back to a September 2022 decision by the NLRB, where it concluded that Illinois quarries, part of RiverStone Group Inc., had not violated the NLRA by implementing changes to the punch-in policy for strike replacements. The board found that the company had unlawfully imposed changes without bargaining with Local 150.
