In a landmark 7-2 ruling that has sent shockwaves through both the agricultural and public health worlds, the U.S. Supreme Court has effectively protected Bayer from state-level lawsuits claiming the company failed to warn users about cancer risks linked to its blockbuster weedkiller Roundup and its key ingredient glyphosate.

Justice Brett Kavanaugh, writing for the majority, determined that because the Environmental Protection Agency considers glyphosate safe when used as directed and has not required cancer warnings, federal law preempts conflicting state failure-to-warn claims under the Federal Insecticide, Fungicide, and Rodenticide Act (FIFRA).

The decision stems from a case involving plaintiff John Durnell, who won more than $1 million from a Missouri jury in 2019. The Supreme Court reversed that verdict and remanded the case, likely dooming thousands of similar lawsuits still pending against Bayer, which inherited the massive legal liability after acquiring Monsanto in 2018.

Bayer hailed the outcome as “good for science, farmers, and industries that depend on regulatory clarity,” saying it should lead to the dismissal of current and future warning-based claims.

This ruling represents a significant victory for Bayer and the Trump administration’s regulatory approach, but it lands as a bitter disappointment for the Make America Healthy Again (MAHA) movement and advocates like RFK Jr., who once successfully litigated a similar case against Monsanto. Critics argue the decision prioritizes corporate protection over consumer safety, especially given the World Health Organization’s 2015 classification of glyphosate as “probably carcinogenic to humans.”

The case highlights the ongoing tension between federal pesticide regulations and state tort law. While the EPA has stood by glyphosate’s safety, thousands of plaintiffs have claimed long-term exposure caused non-Hodgkin lymphoma and other cancers. The Court’s emphasis on uniformity in labeling could reshape how chemical companies defend against future litigation nationwide.

For Bayer, this provides much-needed relief after years of costly legal battles. For patients and their families who believe they were harmed, it feels like another barrier to accountability. As dissenting Justices Ketanji Brown Jackson and Neil Gorsuch noted, the majority’s view departs from the consensus of many lower courts.

The decision could have far-reaching implications for how the legal system balances innovation, regulation, and individual harm in the multi-billion-dollar agricultural chemicals industry.
