Take It Down Act Gets Backlash from Digital Rights Advocates

Take It Down Act

The newly signed Take It Down Act, designed to curb revenge porn and deepfake abuse, has been lauded as a long-overdue victory for victims of nonconsensual image distribution.

Despite its good intentions, the law has also raised serious concerns among digital rights advocates and free speech watchdogs who fear it could lead to overreach, vague enforcement, and broad censorship.

 

What the Take It Down Act Does

Signed into law following a bipartisan push and a public endorsement from former President Donald Trump, the Take It Down Act criminalizes the distribution of nonconsensual explicit images. It doesn’t matter if they are real or AI-generated.

The law requires social media platforms and websites to remove the offending content within 48 hours of a takedown request or face potential liability.

“We want to protect victims, but the bill’s enforcement mechanisms are alarmingly vague,” said India McKinney, Director of Federal Affairs at the Electronic Frontier Foundation (EFF). “Content moderation at scale is widely problematic and always ends up with important and necessary speech being censored.”

While victims or their representatives must submit the takedown request, the law requires only a physical or electronic signature—no ID verification or proof is needed, which critics argue opens the door for fraudulent or politically motivated takedown attempts.

 

Celebration and Criticism

President Trump publicly celebrated the bill’s passage in a March 4 address, saying:

“And I’m going to use that bill for myself, too, if you don’t mind. There’s nobody who gets treated worse than I do online.”

While many hailed the act as a necessary step to combat online harassment, others noted troubling patterns. Senator Marsha Blackburn, who co-sponsored the bill, has also supported the Kids Online Safety Act and voiced opposition to LGBTQ+ content. Critics worry that platforms will err on the side of over-removal, suppressing legitimate content, particularly LGBTQ+ and sex-positive media.

“I think there are going to be more requests to take down images depicting queer and trans people in relationships,” McKinney warned. “And even more than that, I think it’s gonna be consensual porn.”

 

Decentralized Platforms at Risk

Decentralized platforms like Mastodon, Bluesky, and Pixelfed are especially vulnerable to the 48-hour takedown rule, since many are run by nonprofit or individual operators. 

The Federal Trade Commission (FTC) can now treat noncompliance as an “unfair or deceptive act,” potentially subjecting even small hosts to penalties.

Mastodon said it will likely lean toward taking down content if it's too difficult to verify the legitimacy of a claim.

 

The AI Factor: Content Moderation Before Upload

Companies are turning to AI to manage compliance. Hive, a startup that builds content moderation APIs, is already working with platforms like Reddit, Giphy, and Bluesky to detect explicit imagery and deepfakes.

“We were actually one of the tech companies that endorsed that bill,” said Kevin Guo, Hive’s CEO. “It’ll help solve some pretty important problems and compel these platforms to adopt solutions more proactively.”

Hive, now valued at $2 billion, provides tools that platforms often implement at the point of upload, meaning content is scanned before it’s even published.

Slippery Slope to Surveillance?

While the Take It Down Act targets public or semi-public content, it also instructs platforms to “remove and make reasonable efforts to prevent reupload.” Critics say this could push tech companies to scan even encrypted messages.

“This kind of monitoring could extend into encrypted messages in the future,” said McKinney. “The law doesn’t carve out exceptions for services like Signal or iMessage.”

EFF and the Cyber Civil Rights Initiative have both called for more robust safeguards to ensure civil liberties are protected.

States with Revenge Porn Laws

While the federal law is new, some states already have revenge porn legislation in place. These include:

  • California
  • New York
  • Texas
  • Illinois
  • Florida
  • Washington
  • Maryland
  • North Carolina
  • Virginia
  • Colorado

Political Overtones

The timing of the bill has led some to speculate about its political use. The Trump administration has also clashed with academic institutions, including a recent decision to bar Harvard University from accepting foreign students and freezing federal funding.

“At a time when we’re seeing politicians ban books and restrict content like climate change and reproductive rights, it’s deeply uncomfortable to see both parties advocate for this level of content moderation,” McKinney said.
