Taylor Swift, Deepfake Porn and the No AI FRAUD legislation

Platforms like OpenSource’s ChatGPT demonstrate the widespread integration of AI into various aspects of online interactions.

According to the Council of State Governments, 17 states have enacted 29 bills focusing on AI regulation since 2019. Not all of these bills explicitly target the problem of deepfake pornography.

Swift’s Case of Deepfake porn

Using Taylor Swift’s case as an example, the lack of uniformity in state laws poses challenges.

For instance, Tennessee, where Swift has a residence, currently lacks a law explicitly prohibiting deepfake porn.

However, there are positive developments, with Governor Bill Lee proposing the Ensuring Likeness Voice and Image Security (ELVIS) Act to address AI protection under the state’s existing laws.

In New York, where Swift also owns homes, there are criminal and civil options available for victims of deepfake abuse. 

The state banned the distribution of AI-generated pornographic images without the subject’s consent in 2023, imposing fines and potential jail time for violators.
