Taylor Swift, Deepfake Porn and the No AI FRAUD legislation

Deep Fake Porn

Taylor Swift is the victim of Deepfake porn.  AI created sexually explicit images of the singer-songwriter flooded the internet last week.

Swift's likeness was used without her permission to create AI-generated, deepfake pornography.

In the ever-evolving landscape of artificial intelligence, the rise of deepfake porn has thrust society into uncharted territory.

It raises profound moral, ethical, philosophical, and legal questions. This issue becomes even more complex when it involves celebrities like Taylor Swift.

The Swift Incident 

Taylor is one of the richest and best-known people on the planet. And if it can happen to her, it can happen to anyone (most likely women).

Make no mistake, deepfake porn is used to humiliate, harass, punish and threaten women.

There is a growing feeling U.S. citizens should be legally protected against AI abuse.

Social media users saw the fabricated images of Swift and her massive fanbase aka the Swifties are up in arms.

The spread of Deepfake Porn has Big Tech, womens groups and politicians paying attention and looking for solutions.

The alarming incident involved the fabrication of explicit images of Taylor Swift using AI-generated deepfake technology. 

Deepfake Porn 

Screenshots of these manipulated images went viral on X, Elon Musk’s popular social media platform. And amassed over 47 million views before the account responsible was suspended. 

Efforts were made to block searches for Swift's name on the platform temporarily, highlighting the urgency of addressing the rampant dissemination of such content.

Despite these measures, the explicit images found their way onto other social media platforms, emphasizing the challenges of combating deepfake content once it enters the webstream. 

The No AI FRAUD Legislation

In response to the growing threat posed by AI abuse, a bipartisan group of US House lawmakers introduced the No Artificial Intelligence Fake Replicas, And Unauthorized Duplications (No AI FRAUD) Act on January 10. 

Led by Rep. María Elvira Salazar, the legislation aims to establish a federal framework protecting individuals' rights to their likeness and voice against AI-generated fakes and forgeries.

Rep. Salazar emphasized the relevance of the bill in light of Taylor Swift's case, labeling it a clear example of AI abuse. The No AI FRAUD Act seeks to punish those utilizing generative AI to harm others, be they celebrities or not. Its overarching goal is to safeguard every individual's right to control their own image and voice in the digital age.

The convergence of technology, morality, and legality in the context of deepfake porn demands careful consideration and legislative action.

The No AI FRAUD Act represents a crucial step towards establishing a federal framework to address AI abuse.

The Evolving Landscape of AI Technology

Over the past two years, AI technology has advanced and become more accessible, evolving from highly technical coding to user-friendly applications and websites. 

Platforms like OpenSource’s ChatGPT demonstrate the widespread integration of AI into various aspects of online interactions.

According to the Council of State Governments, 17 states have enacted 29 bills focusing on AI regulation since 2019. Not all of these bills explicitly target the problem of deepfake pornography.

Swift’s Case of Deepfake porn

Using Taylor Swift's case as an example, the lack of uniformity in state laws poses challenges. 

For instance, Tennessee, where Swift has a residence, currently lacks a law explicitly prohibiting deepfake porn.

However, there are positive developments, with Governor Bill Lee proposing the Ensuring Likeness Voice and Image Security (ELVIS) Act to address AI protection under the state's existing laws.

In New York, where Swift also owns homes, there are criminal and civil options available for victims of deepfake abuse. 

The state banned the distribution of AI-generated pornographic images without the subject's consent in 2023, imposing fines and potential jail time for violators.

Rhode Island and California, where Swift has residences, currently have varying degrees of legislative coverage on deepfake and synthetic media laws.

Rhode Island lacks specific legislation, while California passed a law in 2020 allowing victims of nonconsensual deepfake pornography to sue creators and distributors for damages.
