Former Trump adviser Peter Navarro finds himself embroiled in a legal battle as he seeks to avoid reporting to federal prison next week to start a four-month sentence for contempt of Congress. 

Navarro, ordered to a Miami prison by March 19, has filed an emergency request with the Supreme Court. He is pleading to remain free while he contests his conviction before the federal appeals court in Washington, DC.

Peter Navarro Appeal to Supreme Court

Navarro's legal team argues that pausing the lower court's ruling is warranted given his non-flight risk status and the substantial legal questions raised by his appeal. 

His attorneys assert Navarro's commitment to due legal process. They contend that his appeal presents significant issues likely to result in the reversal of his conviction or a new trial.

Supreme Court Response

Both lower courts have rejected similar appeals, questioning the merits of his arguments. The DC Circuit Court of Appeals, in a unanimous decision, dismissed Navarro's bid, stating that he failed to demonstrate substantial questions of law or fact that could lead to a favorable outcome for him. 

The Supreme Court has requested a response from prosecutors, setting the stage for a critical legal showdown.

Background 

Navarro's case is linked to the lower court’s denial of his executive privilege defense at trial. He believes that this was a court error.

 Drawing comparisons to the treatment of Trump ally Steve Bannon, Navarro argues that the possibility of the appeals court overturning the decision should spare him from imprisonment pending the resolution of his case.

Bannon, sentenced for a similar offense, was allowed to remain free during his appeal process.

The pending appeal is focused on the ex-presidential aide’s executive privilege claims. If his conviction for refusing to testify stands this would be the first time a presidential aide would be denied executive privilege.
