Elon Musk’s pro-Trump America PAC has introduced an incentive program offering $47 to individuals who successfully get a registered swing-state voter to sign a petition in support of the First and Second Amendments. Musk referred to the initiative as “easy money” in a post on his platform, X (formerly Twitter).

While directly paying individuals to register voters is illegal, America PAC seems to navigate this restriction by rewarding those who refer registered voters to the petition. Musk and the PAC have actively pushed for increased voter registration in swing states as key deadlines approach. When asked for a comment, America PAC’s representatives remained silent.

This is a legal loophole of sorts that PACs on both sides of the aisle have used several times in the past, but hasn't received so much media attention until someone as notable as Musk decided to throw his hat in the ring.

The $47 incentive quickly spread on social media, particularly on X, Musk’s platform, where America PAC recently took control of the handle “@america,” previously belonging to another account. Now marked as an official organization on X, the account has promoted the pro-Constitution petition, swing-state voter registration, and the $47 offer.

Dr. Richard Hasen, an election law professor at UCLA and an analyst for NBC News, noted that Musk’s approach was unprecedented. "He has used the platform to support Trump in a way that's far more overt than we've ever seen from any other media or social platform," Hasen said. Despite this, Hasen believes Musk has not violated campaign finance laws, as long as he continues to disclose his ties to Trump.

America PAC, founded in May, has previously drawn attention for its unconventional methods to drive voter registration in swing states. The super PAC has received donations from Musk, who endorsed Trump following an assassination attempt in July, as well as from his Silicon Valley peers. The group has run ads on social media platforms like Facebook and Instagram targeting swing-state voters.

In August, America PAC’s website was criticized for collecting personal data under the pretext of voter registration, only fully directing individuals in swing states to complete the process. Election officials in Michigan and North Carolina opened inquiries into whether the site was misleading, but Michigan officials ultimately found no evidence of state campaign finance violations. America PAC declined to comment on the investigations.

According to OpenSecrets, America PAC has spent over $77 million thus far, with more than $41 million going to support Republicans and over $35 million opposing Democrats. The PAC’s website now features conservative posts from X and offers paid opportunities to increase voter turnout in swing states, advertising a starting rate of $30 per hour with performance-based bonuses.

“It’s a lot of money to offer,” Hasen remarked, adding, “Only someone incredibly wealthy would consider such an offer, and it remains to be seen if it will have any significant impact.”

With both Republicans and Democrats surging hundreds of millions of dollars into efforts to register and mobilize voters, this presidential election could have a record-breaking turnout. Celebrities and moguls like Musk, Peter Thiel, Jeff Bezos, Bill Gates and Oprah Winfrey are leading well-funded campaigns to reach Americans by phone, text and social media to encourage them to get out and vote for their respective chosen candidates.
