Amber Heard Defense Cost Drama: Insurer Fights to Disqualify Law Firm Over Conflict of Interest

But today, I bring you a gripping tale of courtroom conflicts, high-stakes insurance battles, and the legal drama surrounding Hollywood celebrities, Amber Heard and Johnny Depp. Our story unfolds with an insurer, New York Marine and General Insurance Co. (NY Marine), striving to disqualify law firm Maynard Cooper & Gale LLP from representing Travelers Commercial Insurance Co. (Travelers) in a battle over defense costs for Amber Heard in a defamation lawsuit brought forth by Johnny Depp.

At the heart of the issue is Matthew A. Chipman, a lawyer who now works for Maynard Cooper. The problem? He used to be employed by McCormick Barstow Sheppard Wayte & Carruth LLP, the very same firm that represented NY Marine in another case involving Amber Heard. This twist of fate has left Chipman privy to confidential information, creating what NY Marine describes as a "direct and irreconcilable ethical conflict."

As an experienced legal analyst, I can't help but concur with NY Marine's concerns. The risk of Chipman inadvertently or intentionally sharing the insurer's confidential information with his new firm is a genuine threat. And, unfortunately for Travelers, it seems they're unable to effectively prevent this conflict of interest from arising.

California law is clear on the matter: "when a 'tainted attorney was actually involved in the representation of the first client, and switches sides in the same case, no amount of screening will be sufficient, and the presumption of imputed knowledge is conclusive,' thereby requiring the disqualification of the tainted firm."

The legal timeline is crucial in understanding this complex case. NY Marine initially retained McCormick Barstow in October 2020 to serve as coverage counsel in its dispute with Travelers, concerning the defense of their mutual insured, Amber Heard, subject to a reservation of rights, in underlying litigation in Virginia. Fast forward to July 2021, Travelers filed a lawsuit against NY Marine, accusing the insurer of not paying its full share of defense costs for the defamation suit Depp brought against Heard in Virginia state court in 2019.

To further complicate matters, about a year later, NY Marine filed a lawsuit against Heard, claiming it isn't responsible under a policy issued to Heard to help pay for a defense that ended up with a jury verdict in favor of Depp over critical public statements the actor made after their divorce.

Chipman, who worked as an associate attorney in the insurance coverage and bad faith litigation practice group at McCormick Barstow from October 2020 to April 2022, then joined Maynard Cooper and found himself under the direct supervision of Travelers' attorney, Nicholas J. Boos.

NY Marine argues that an ethical screening to prevent a conflict of interest wasn't implemented until after the insurer raised the issue with Travelers' counsel. Consequently, even if Chipman hadn't represented NY Marine in the suit at hand or possessed the insurer's confidential information, Maynard Cooper's failure to implement an ethical screening before undertaking Travelers' representation does not excuse the firm from disqualification, according to NY Marine.

In my view, "The stakes are incredibly high in this case, and the potential for a conflict of interest to compromise the integrity of the proceedings is simply too great to ignore. The court must prioritize fairness and transparency, which calls for the disqualification of the tainted firm."
