Could You Be Owed Money From the Massive 87.5 Million Dollar Beef Settlement

Time is rapidly running out for millions of Americans to claim their share of an $87.5 million antitrust settlement involving some of the largest beef processors in the country. If you have purchased beef products for personal use at any point during a five year window, you might be eligible for a cash payment. With the deadline approaching within just a few days, now is the moment to verify your eligibility and submit your claim.

The Background of the Beef Price Fixing Allegations

The origins of this substantial settlement trace back to a class action lawsuit filed by a group of consumers against major players in the beef industry. The defendants listed in the litigation included household names such as Tyson Foods, Cargill, National Beef, and JBS.

The plaintiffs in the case alleged that these powerful beef processors participated in a market allocation agreement. According to the lawsuit, this agreement effectively stifled competition for market share among the companies. By coordinating their efforts, the processors were accused of artificially increasing their profit margins while simultaneously driving up the retail prices that everyday consumers paid at the supermarket checkout.

While the companies involved have not admitted to any wrongdoing and the court has not issued a ruling confirming these allegations, Tyson and Cargill have opted to resolve the claims through settlement agreements. Tyson Foods has agreed to pay $55 million, and Cargill has committed to $32.5 million. Together, this total pool of $87.5 million will be distributed as cash payments to eligible consumers who purchased qualifying beef products.

Are You Eligible for a Payout

Determining your eligibility is straightforward, but it relies on specific criteria regarding where and when you made your purchases. To qualify, you must have purchased beef products for personal consumption between August 1, 2014, and December 31, 2019.

Additionally, your purchases must have been made at a grocery store or supermarket located in one of the following jurisdictions: Arizona, California, Florida, Illinois, Iowa, Kansas, Massachusetts, Maine, Michigan, Minnesota, Missouri, Montana, Nebraska, Nevada, New Hampshire, New Mexico, New York, North Carolina, North Dakota, Oregon, Rhode Island, South Dakota, Tennessee, Utah, West Virginia, or Wisconsin. The District of Columbia is also included in this list.

It is important to note that the beef must have been purchased from a retail outlet rather than directly from the processors themselves.

Understanding Which Beef Products Qualify

The settlement covers more than 280 specific types of beef. In general, these include fresh and frozen items such as round, rib, loin, and chuck primal cuts.

However, there are significant exclusions you should be aware of. The settlement does not apply to beef that was marketed as premium, specialty, or processed. Specifically, you cannot claim for products that were labeled as:

  • Premium beef such as USDA Prime, organic, 100 percent grass fed, Wagyu, or American Style Kobe Beef.

  • Specialty beef including products labeled as kosher, halal, certified humane, or those marketed as antibiotic free or No Antibiotics Ever.

  • Processed beef which includes marinated, seasoned, ground, flavored, breaded, or cooked items.

How to File Your Claim Before the Deadline

You must submit your claim by this coming Tuesday, June 30. You can complete the process online or by submitting a paper form via mail.

The online application process requires basic information such as your name, contact details, and address. You will also be required to complete a questionnaire regarding your purchasing habits during the eligible period. This includes estimates of how many pounds of qualifying beef you purchased and the average amount you spent on these products on a monthly basis.

When filing, you will have the option to select your preferred method of payment. Eligible claimants can choose to receive a check by mail, a direct electronic payment via Venmo or PayPal, or a digital gift card for retailers like Amazon, Starbucks, or Instacart.

What Happens After You File

It is essential to understand that by submitting a claim, you are agreeing to release your right to sue Tyson and Cargill over the specific allegations contained in this lawsuit. Furthermore, because a judge has yet to grant final approval for these settlements, payments will not be issued immediately. Additional delays could also arise if there are formal objections to the case.

If you believe you have grounds to object to the terms of this settlement, you have until March 30, 2026, to submit your written objection. Otherwise, if you qualify, ensure you take action now to secure your portion of the settlement before the deadline expires.
