Fatal Accident in Tulsa: Oklahoma Father Sentenced After Daughter Dies in Rollover Crash

A Fatal Accident in Tulsa that claimed the life of a 16-year-old girl has resulted in a prison sentence for her father, whose actions before and after the crash became the focus of a high-profile criminal case.

Elliott Lincoln Binney, 43, was sentenced to five years in prison after pleading guilty to multiple charges connected to the January 2024 rollover crash that killed his daughter, Shelby Binney.

The tragic case drew widespread attention across Oklahoma after authorities alleged Binney fled the scene on foot, leaving behind his injured family members following the deadly wreck.

Father in Fatal Accident Pleads Guilty

Court records show Binney pleaded guilty in April to first-degree manslaughter, child neglect, leaving the scene of a fatal accident, and transporting an open container.

According to prosecutors, Binney admitted to taking a “gulp” of vodka moments before the crash. However, Tulsa County prosecutors acknowledged there was insufficient evidence to prove beyond a reasonable doubt that he was legally impaired while operating the vehicle.

Tulsa County District Attorney Steve Kunzweiler explained the legal limitations of the case during sentencing proceedings.

“There was no provable evidence beyond a reasonable doubt that he was driving his family while he was impaired,” Kunzweiler told the court.

Details of the Fatal Accident

The crash occurred on Jan. 11, 2024, near East 171st Street South in the Tulsa-area community of Bixby. According to investigators, emergency responders from the Bixby Police Department and local fire crews arrived at the scene after reports of a serious single-vehicle rollover accident.

Authorities discovered that Shelby Binney had been ejected from the vehicle during the crash. She later died from her injuries.

Binney’s wife, Brittany, and the couple’s other children were found inside the wrecked vehicle and transported to a hospital for treatment.

Investigators determined that dangerous driving during poor weather conditions contributed to the collision. Witnesses reportedly told police that Binney was traveling at a high rate of speed and attempted to pass vehicles on a rain-slick roadway while crossing into a no-passing zone.

The maneuver allegedly caused him to lose control of the vehicle, resulting in the rollover.

Dad Fled the Scene Leaving Behind an Open Vodka Bottle

Investigators also discovered an open bottle of vodka inside the vehicle. Authorities said Binney later admitted he had consumed alcohol shortly before the crash.

Despite the severity of the accident, prosecutors said Binney left the scene before emergency personnel arrived.

According to investigators, he fled on foot and later obtained another vehicle from a nearby business before leaving the area. Authorities eventually located and arrested him in the city of Checotah, approximately 50 miles away.

His decision to leave the crash scene became a central issue in the prosecution’s case.

Family Pleads for Leniency in Fatal Accident Case

During sentencing, Brittany Binney urged the court to show mercy to her husband, arguing that the tragedy had already devastated the family.

She told the court that her husband had been deeply affected by the loss of their daughter and would carry that burden for the rest of his life.

Brittany also expressed concern about the impact her husband being in prison

would have on their surviving children.

“They have already suffered the unimaginable loss of their sister,” she said. “If their father is removed from their lives through a lengthy incarceration, they will experience another profound loss.”

Judge Sides with Prosecutors

Although family members sought leniency, prosecutors recommended a prison sentence ranging from two to five years.

Kunzweiler acknowledged that criminal cases sometimes place prosecutors at odds with the wishes of victims and family members.

“Sometimes criminal cases are like that — where a victim may prefer one outcome, and I have to take a position inconsistent with the victim's desires,” he said.

Ultimately, the judge imposed the maximum sentence requested by prosecutors, ordering Binney to serve five years in prison.

The case serves as a reminder of the devastating consequences that reckless driving, poor decision-making, and fleeing an accident scene can have on families and communities.
