A New Chapter for Second Amendment Rights?

For millions of Americans with felony convictions, the right to own a firearm has been lost—often permanently. For decades, federal law has imposed a blanket prohibition, leaving countless individuals unable to exercise what the Supreme Court has recognized as a core constitutional right. Now, the U.S. Department of Justice (DOJ) has published a proposed rule that, if enacted, would provide a formal process for certain individuals to apply for restoration of their gun rights under federal law.

This historic move is already generating fierce debate. Is it a long-overdue correction to government overreach, or a dangerous gamble with public safety? The proposed rule—titled Application for Relief from Disabilities Imposed by Federal Laws with Respect to the Acquisition, Receipt, Transfer, Shipment, Transportation, or Possession of Firearms—lays out new criteria, hurdles, and opportunities that every affected American needs to understand.

How Did We Get Here?

A Brief Legal History

The Gun Control Act of 1968 was designed to “keep firearms away from the persons Congress classified as potentially irresponsible and dangerous.” This meant that anyone convicted of a felony—any crime punishable by more than a year in prison—was barred from possessing a firearm. Congress did, however, create a mechanism in 18 U.S.C. 925(c) for certain people to apply to the Attorney General for relief from this disability, provided they could show they were not “likely to act in a manner dangerous to public safety” and that granting relief was not “contrary to the public interest.”

For years, this relief was rarely granted, and beginning in 1992, Congress specifically barred ATF from spending funds to process these applications. As a result, there has been virtually no practical pathway for individuals—no matter how long ago or non-violent their offense—to restore their federal gun rights.

Recent Supreme Court cases (Heller, Bruen, Rahimi) have elevated the Second Amendment’s individual protections, fueling legal challenges to “permanent” disarmament and demanding a more nuanced, individualized approach.

What Does the DOJ’s Proposed Rule Change?

The new DOJ rule—now open for public comment—would finally operationalize the process Congress intended under Section 925(c). Here’s what’s most important:

Who is Eligible (and Who Isn’t):

  • Presumptively Disqualified:
    • Anyone convicted of violent felonies (including murder, rape, kidnapping, robbery, arson, or any crime involving serious violence)
    • Those convicted of felony sex offenses or currently required to register as sex offenders
    • Convicted domestic abusers, drug traffickers, or those recently serving criminal sentences
    • Persons currently on probation, parole, or other supervision, or who have had gun rights restoration applications denied for similar reasons within five years
    • Individuals currently subject to federal firearm prohibitions (e.g., fugitives, those under restraining orders, or unlawful users of controlled substances)

For these categories, relief will only be considered in “extraordinary circumstances.” In practice, most applications from violent or high-risk offenders will be denied.

Who May Qualify:

  • Non-violent felons whose convictions are older, who have completed all sentences and supervision, and who have maintained a clean record for a set period (five or ten years depending on the type of offense)
  • Applicants must demonstrate good behavior and provide extensive documentation—including criminal background checks, reference affidavits, and details of the conviction and rehabilitation

Important:

  • Restoration applies only to federal law; if a state also bars gun ownership, separate state relief is needed.
  • The Attorney General has wide discretion and will consider all circumstances—including new criminal conduct, repeated arrests, or association with criminal groups.

How Will the Process Work?

Application & Review:

  • Individuals will be able to apply online or by mail, submitting detailed documentation of their criminal history, rehabilitation, and supporting reference letters.
  • The DOJ will notify local law enforcement of all applications, seeking community input about any risks posed by the applicant.
  • Each application will take about an hour to complete and will include a $20 fee (with waivers available for indigent applicants).

Review Timeline:

  • The DOJ estimates over one million applications in the first year.
  • The proposed rule is open for public comment for 90 days; it is not yet the law and will require formal adoption and likely modification in response to public and legal feedback.

What Can Prior Felons Do Right Now?

  • Monitor the Federal Register:Track updates and the final rule’s publication.
  • Prepare Documentation:Begin gathering court records, proof of completed sentences, character references, and evidence of rehabilitation.
  • Participate in the Comment Period:The DOJ “welcomes comments” from those affected. This is a rare opportunity to influence federal policy—submit your views at https://www.regulations.gov.
  • Do Not Submit Applications Yet:DOJ is not yet processing applications until the rule is finalized.

What Hurdles Remain?

Legal:

  • The application process will be rigorous, with many disqualifying offenses and tight scrutiny on recidivism, violence, or risk factors.
  • Even after relief under federal law, state prohibitions may remain in place.
  • If an applicant is found to have made any material misrepresentation or omitted critical information, relief can be revoked.

Practical:

  • The DOJ expects high volume and resource strain in processing—delays are likely.
  • Application fees and documentation requirements may present barriers for low-income individuals.
  • Not all prior felons will qualify, and those with a history of violence, sex offenses, or recent criminal activity are almost certainly ineligible.

Multiple Viewpoints: A Nation Divided

Attorney General Pamela Bondi defends the rule as a needed “fair and thoughtful system” that upholds constitutional rights while prioritizing public safety. Civil liberties groups praise the rule’s individualized approach but warn it doesn’t go far enough for non-violent offenders. Critics—including some law enforcement and victim’s advocates—fear the system could be abused or insufficiently protect the public.

Final Thoughts

The DOJ’s proposed rule is a historic step for Second Amendment rights—and a major policy gamble. If enacted, it would create a meaningful pathway for certain prior felons to regain their rights after years or even decades of exclusion. But the process will be selective, complex, and—at least for now—subject to intense political and legal debate.
