Tuesday was the “safe harbor” date. That is the date by which federal law requires states to resolve all election-related disputes before the Electoral College votes.

The Electoral college votes six days after the “safe harbor” date, December 14. But, technically, the electoral college results are not official until they are certified by a joint session of the House and Senate.

“It is not unprecedented for an election to last beyond December 8,” the president’s attorneys, former New York City Mayor Rudy Giuliani and Jenna Ellis said. “The only fixed day in the U.S. Constitution is the inauguration of the president on January 20th at noon.”
