Joaquin Altenberg first appeared in a Delaware Chancery Court on September 24^th for a lawsuit brought by Plaintiffs HOMF II Investment Corp for fraud.  Joaquin was found liable for $5,556,197 and was ordered to repay $1,721,259.90 in plaintiffs' legal fees, plus $810.28 in daily interest based on the court's finding of "egregious fraud and misrepresentation" and "serial misconduct" on Joaquin's part.

Now Joaquin’s wife, Alison Altenberg, is to stand trial for her role in the alleged fraud. Alison is the daughter of professor Leonard E. Weisman, a West Point graduate and currently a professor at the Baylor College of Medicine.

The lawsuit alleges that Alison accepted an "office manager" role, where she intentionally defrauded the fund and was paid a high 5 figure salary for duties she allegedly never performed.

According to the lawsuit, Alison Altenberg never had the experience to qualify for the role of "office manager" of a company that had a singular goal to seek and assess solar energy investment opportunities to present to HOMF II fund for approval.

Furthermore, it's alleged that Alison never, in fact, managed an office at Solar Finance, despite holding the title of "office manager," nor did she hold a consistent work schedule to justify her excessively high salary. In addition, it's alleged that Alison did not know the name of key employees, nor does she have employees report to her. Despite this, she still earns more than several employees who worked full time for Solar Finance.

"Defendant's experience outlined [in the lawsuit] did not qualify her to operate and manage renewable energy development projects. Despite the presumed title of Office Manager, Defendant does not maintain an office at Solar Finance, does not maintain a regular work week schedule (e.g., Monday through Friday, 40 hours a week) to earn her excessive salary, does not maintain or use a Solar Finance e-mail address, has no employees who report to her, has no access to Solar Finance's Google or Microsoft Office Suite systems, and does not know the names of key employees, their respective titles, or their respective salaries. Indeed, the same key employees do not even know that Solar Finance employed Defendant. Yet, Defendant earns more than some of these full-time employees."

As if matters weren't bad enough, it’s alleged that Mrs. Altenberg took an additional 5 figure bonus from the HOMF II investment fund, which she allegedly lied about while under oath.

The lawsuit further alleges that Alison Altenberg aided and abetted the breach of fiduciary duties that her husband Joaquin Altenberg owed to the Plaintiff.  She was also accused of conspiracy to commit fraud against HOMF II.

Finally, it was discovered that Alison spent over $200k at Nordstrom's in light of the fact that her husband was facing a trial for fraud and stealing from his investors.

The attorneys representing Alison filed a motion for full summary judgement, which was denied in part.   Now the case is moving toward trial and Alison Altenberg faces the following charges:

• Unjust Enrichment
• Conspiracy to Commit Breach of Fiduciary Duty
