Biden Cognitive Issues: Court Fight Over Recordings Renews Questions About Former President’s Mental Fitness

Questions about Biden cognitive issues surround the former President. This is once again in the national spotlight as a legal battle over the release of audio recordings threatens to revive questions about his memory and mental acuity. 

The Justice Department is preparing to provide recordings of Biden's 2016 and 2017 interviews with ghostwriter Mark Zwonitzer to the House Judiciary Committee unless federal courts intervene, while a separate lawsuit seeks public release of the same recordings.

The dispute has renewed debate over Biden's cognitive abilities before and during his presidency, an issue that dominated much of the 2024 presidential campaign and has continued to generate political controversy.

DOJ Plans to Release Recordings That May Reveal Biden Cognitive Issues

The Justice Department has indicated it intends to provide approximately two hours of audio recordings to the Republican-led House Judiciary Committee within the coming weeks unless an appeals court blocks the move.

The committee, chaired by Rep. Jim Jordan, has sought the recordings for years as part of its oversight investigations.

At the same time, the Heritage Foundation is pursuing public disclosure of the recordings through a Freedom of Information Act lawsuit.

Litigation Continues

Last week, U.S. District Judge Dabney Friedrich ruled that the Justice Department acted within its authority in deciding to release the recordings after appropriate redactions.

The judge noted that many of Biden's privacy concerns had been addressed because references to highly personal matters—including illnesses, deaths and private family members—had already been removed.

Recordings Stem from Classified Documents Investigation

The interviews were conducted while Biden worked with author Mark Zwonitzer on his memoir, Promise Me, Dad.

During Special Counsel Robert Hur's investigation into Biden's handling of classified documents, prosecutors reviewed those recordings to determine whether classified information had been improperly disclosed.

Hur ultimately declined to bring criminal charges, concluding that prosecutors would likely have difficulty convincing a jury that Biden intentionally violated the law.

However, Hur's report drew widespread attention after describing Biden as "a sympathetic, well-meaning, elderly man with a poor memory" and noting that the former president sometimes appeared "painfully slow" during interviews.

Separate recordings from Hur's 2023 interview with Biden have already been released publicly.

Debate Over Biden Cognitive Issues and Mental Acuity 

Questions about Biden's age and mental sharpness followed him throughout much of his presidency.

Republican lawmakers, conservative organizations and many political commentators argued that repeated verbal miscues, memory lapses and limited public appearances suggested cognitive decline. They have also alleged that senior White House aides and political allies worked to minimize public exposure to unscripted events and carefully managed the president's schedule and media interactions.

Biden and many of his former aides rejected accusations of a coordinated cover-up, arguing that political opponents selectively highlighted mistakes while ignoring the president's legislative accomplishments and demanding schedule.

The issue intensified following Biden's widely criticized debate performance during the 2024 presidential campaign, which ultimately contributed to his decision to withdraw from the race.

Books Examining the Biden Cognitive Issues

Several books published by journalists and political insiders have explored concerns surrounding Biden's age, decision-making, and the internal efforts by aides to manage public perceptions.

Among the most widely discussed are:

  • Original Sin: President Biden's Decline, Its Cover-Up, and His Disastrous Choice to Run Again by Jake Tapper and Alex Thompson.
  • Fight: Inside the Wildest Battle for the White House by Jonathan Allen and Amie Parnes, which examines the political fallout surrounding Biden's reelection campaign.
  • The Fight of His Life: Inside Joe Biden's White House, a New York Times best-seller. Author Chris Whipple discusses Biden's final months as a candidate and concerns raised by advisers.

The books rely on interviews with White House officials, campaign staff, Democratic strategists and other insiders, though some individuals involved have disputed portions of the accounts.

Appeals Continue

Biden's legal team is continuing to fight both the congressional release and the public disclosure of the recordings.

His attorneys argue that the conversations contain personal material and that the Justice Department's decision to release them under the Trump administration is politically motivated.

Meanwhile, supporters of disclosure argue that the recordings are of significant public interest because they could shed further light on Biden's memory and decision-making during a period that predated his presidency.

The appellate courts are expected to determine in the coming weeks whether the recordings will remain sealed or become available to Congress and, potentially, the general public.
