WASHINGTON, DC - The corridors of American political power are again echoing with the thunder of Congressional subpoenas—this time targeting heavyweights such as Bill Clinton, Hillary Clinton, James Comey, Robert Mueller, Merrick Garland, and Bill Barr in connection with the sprawling Jeffrey Epstein investigation. The stakes? The very boundaries of legal accountability for former officials—and the precedent set by Peter Navarro’s recent, hard prison sentence for contempt of Congress.

Background: A Congressional Reckoning

Last week, Rep. James Comer, Chair of the House Oversight Committee, stunned observers by announcing subpoenas for Bill and Hillary Clinton, compelling their testimony in the Epstein probe—Bill slated for October 14, Hillary for October 9. The committee’s move is a response to mounting public calls for transparency and release of all Epstein-related records. Comer also demanded the DOJ produce any material connecting the Clintons to the Epstein investigation.

This flurry of subpoenas opens a legal minefield for the Clintons and others, particularly given the explosive fallout experienced by Peter Navarro—a former White House advisor imprisoned for contempt after refusing to comply with a Congressional subpoena.

The Navarro Example: Prison Time for Defiance

Peter Navarro, once a top trade adviser in the Trump administration, became the first former White House official to do real prison time for contempt of Congress after allegedly ignoring a House Select Committee subpoena regarding the January 6th, 2021, Capitol attack. Navarro, convicted on two counts of contempt in September 2023, argued he was bound by executive privilege—a defense rejected by U.S. District Judge Amit Mehta, who found Navarro failed to present adequate proof that President Trump had formally invoked such privilege. After losing appeals in federal court and at the Supreme Court, Navarro surrendered to authorities in March 2024 and was sentenced to four months at a Miami federal facility—ordered to serve real, unprotected prison time while his appeal is pending.

This precedent shows Congress’s power to compel testimony, regardless of a subject’s past position, and reveals the legal vulnerability of high-profile figures who choose resistance.

Will Bill & Hillary Clinton, Comey, and Others Share Navarro’s Fate?

Anticipated Defenses—and Their Limits

Legal experts expect Bill Clinton (as a former President), Hillary Clinton, and others to vigorously challenge their Congressional subpoenas. Likely strategies include:

  • Asserting Executive or Testimonial Privilege (especially for Bill Clinton as ex-President):
    • The law acknowledges limited immunity for Presidents, but precedent (United States v. Nixon, 1974) restricts its scope, noting immunity claims cannot obstruct the judicial process or Congressional oversight when pursuing significant public interests.
    • Bill Clinton’s team will likely file motions to quash, arguing any compelled testimony could undermine presidential confidentiality. However, courts have repeatedly confirmed that neither status nor privilege creates blanket immunity from Congressional subpoenas—particularly in criminal or high-stakes governmental inquiries.
  • Motions to Quash or Assertions of Immunity:
    • Hillary Clinton and others may argue separation-of-powers or protections for former officials. However, unlike Bill Clinton, Hillary’s protections are considerably weaker, as courts generally hold non-presidential executive officials (even former Secretaries of State) accountable under Congressional subpoena power, as seen in historic confrontations and investigations.
    • Typically, courts ask: Was the privilege formally invoked? Is the information genuinely sensitive, or of significant public interest? These are hurdles that have felled recent attempts, including Navarro’s unsuccessful defense.

If, for instance, Bill or Hillary Clinton make claims during their testimony contradicted by Epstein-related records subpoenaed from the DOJ, committee members may use those materials to “impeach” their statements—showing inconsistencies or outright falsehoods in order to challenge their trustworthiness as witnesses, or subjecting them to perjury. Because depositions allow methodical, document-by-document examination, they can also surface details not previously on the public record—especially when paired with contemporaneous DOJ and agency productions that enable immediate contradiction of any inaccurate claims.
