Judicial Indiscretion Laid Bare

Wilcox of Bergen County is facing the repercussions of his extra-judicial activities in an unusual scenario involving lip-synced songs with sexually explicit content. This case sheds light on the conduct of judicial officers inside and outside the courtroom, raising serious questions about the standard of decorum and propriety expected from individuals in such high positions.
The New Jersey Supreme Court’s Advisory Committee on Judicial Conduct leveled the complaint against Judge Wilcox last Friday. The controversy revolves around a number of TikTok videos filmed by the judge in his chambers, within the courthouse, and even while donning his judicial robes.
It is stated in the complaint that, “By his conduct in posting these and similar videos to TikTok, respondent exhibited poor judgment and demonstrated disrespect for the Judiciary and an inability to conform to the high standards of conduct expected of judges. Such conduct undermines public confidence in the Judiciary and violates several judicial rules.” Clearly, this paints an unsavory picture of a respected figure in the legal world.
TikTok Identity Revealed: The Violations and Transgressions
Under the alias of “Sal Tortorella,” Judge Wilcox posted as many as 40 videos to TikTok from April 2021 to March 2023. Notably, his profile settings were public at times, granting unrestricted access to any viewer.
This situation leaves no doubt that Judge Wilcox violated various rules, including those mandating high standards of conduct and refraining from both impropriety and its semblance. He also broke the rule that compels “judges to conduct their extra-judicial activities in a manner that would not cast reasonable doubt on the judge’s capacity to act impartially as a judge, demean the judicial office, or interfere with the proper performance of judicial duties.”
Not Just a Simple Act of Lip-Syncing
A detailed exploration of these videos reveals a string of questionable choices made by the judge. One video features Judge Wilcox in his chambers, casually dressed in a T-shirt, lip-syncing to the song “Jump” by Rihanna. Its lyrics include a sexual undertone, causing further controversy. Other videos involve the judge lip-syncing to potentially inflammatory lyrics while dressed in a suit with law books as his backdrop. The words he mouths are, “All my life, I’ve been waiting for somebody to whoop my ass. I mean business! You think you can run up on me and whip my monkey ass? Come on. Come on!”.
The compounding acts of indiscretion don’t stop there. Other videos show Judge Wilcox walking around the courthouse sporting a “Beavis and Butt-Head” T-shirt while “Get Down” by Nas plays, a song containing explicit lyrics that reference a criminal case, a courtroom shooting, derogatory and discriminatory terms, drug and gang references, and the murder of a doctor in a hospital who treated a gang member.
A Shocking Scandal from a Renowned Legal Authority
Prior to his appointment in June 2011, Judge Wilcox was a partner with McCarter & English LLP, having earned his law degree from Harvard Law School. Now, almost a decade into his esteemed judicial career, this ethics suit threatens to tarnish his reputation.
Judge Wilcox, thus far, has not commented on the complaint.
