Former FBI Director James Comey Indicted For Threatening To Kill President Trump — Arrest Warrant Issued

A federal grand jury has returned a two-count indictment against James Comey, 65, charging the former FBI Director with threatening the life of President Donald J. Trump via an Instagram post depicting ‘86 47’— and this time, there is a warrant for his arrest. The public may be about to witness a former chief of America’s top law enforcement agency in handcuffs.

The Instagram Post That Started It All

On May 15, 2025, James Comey — the man who once sat atop the most powerful law enforcement agency in the world — posted an image to his public Instagram account that would set off a federal criminal investigation. The image contained the numbers "86 47," a phrase that federal prosecutors and law enforcement officials widely recognize as coded language for killing the 47th President of the United States, Donald J. Trump.

It was not a private message. It was not an accidental share. Comey posted it publicly, to an audience of hundreds of thousands of followers, at a time when, as Acting Attorney General Todd Blanche noted,

“this country has witnessed violent incitement followed by deadly actions against President Trump and other elected officials.”

Federal investigators moved swiftly. The FBI opened an investigation, and on April 28, 2026, a federal grand jury in the Eastern District of North Carolina formally returned an indictment — charging Comey with two serious federal felonies.

The Two Federal Charges: A Legal Analysis

The indictment is a lean, targeted document — two counts, two statutes, one unavoidable legal conclusion if the evidence is as presented. Here is what each charge means and why it matters:

Count 1: Threatening the President (18 U.S.C. §871(a))

This is the heavier charge, and the one with more historical weight. Under Section 871 of Title 18, it is a federal felony to "knowingly and willfully" make any threat to "take the life of, kidnap, or inflict bodily harm upon" the President of the United States.

The government’s legal theory here will center on what courts call the "reasonable recipient" standard,which asks: Would a reasonable person familiar with the circumstances interpret the communication as a serious expression of intent to harm? Prosecutors argue the answer, in the context of an Instagram post by a public political figure using the numeric slang for “kill,” is unambiguously yes.

Critically, the statute does not require that Comey intended to personally carry out the threat — only that the threat was made knowingly and willfully. Courts have consistently held that public figures who broadcast threatening messages to large audiences face the same legal exposure as private individuals who make direct threats.

Maximum sentence under this count: 5 years in federal prison.

Count 2: Transmitting a Threat in Interstate Commerce (18 U.S.C. §875(c))

The second count adds a separate, complementary theory. Section 875(c) makes it illegal to transmit any communication in interstate commerce containing a threat to injure another person. This statute has been interpreted broadly by federal courts, and it covers precisely what Comey allegedly did: posting content on a platform — Instagram — that operates across state lines and internationally.

What makes this charge particularly significant legally is the "conscious disregard" standard. The indictment alleges Comey "consciously disregarded a substantial risk" that his post would be viewed as threatening violence. This is a recklessness standard — meaning prosecutors may not need to prove Comey specifically intended to threaten anyone, only that he knew the risk and posted it anyway.

This is a legally powerful position for prosecutors. It makes the standard of proof somewhat lower than the willfulness required for Count 1, giving the government a fallback position should the defense mount a strong “no intent” argument.

Maximum sentence under this count: 5 years in federal prison.

Combined maximum exposure: 10 years in federal prison.

From Summons to Arrest Warrant: This Time Is Different

Legal observers and political watchers will recall that when Comey was previously charged, he was served with a summons to appear — a relatively routine procedure that allows a defendant to voluntarily present himself to the court without the drama of an arrest. That courtesy appears to have been withdrawn.

This time, an arrest warrant has been issued. That is a consequential distinction. An arrest warrant means federal agents have the authority — and the legal obligation — to take James Comey into physical custody. It means booking. It means fingerprints. It means a mugshot.

And it means the public may be about to see something extraordinary in American history: a former Director of the Federal Bureau of Investigation performing what is colloquially known as the "perp walk."

The optics of this moment will be impossible to overstate. Comey spent years as the face of federal law enforcement — a man who presided over the prosecution of some of the nation’s most dangerous criminals. The prospect of him being walked into a courthouse in handcuffs, photographed for a mugshot, and processed through the very system he once commanded is the kind of scene that rewrites public narratives overnight.

Who Is Prosecuting This Case?

The Eastern District of North Carolina is no stranger to high-profile cases. U.S. Attorney W. Ellis Boyle made the announcement, stating flatly: “No one is above the law in the Eastern District of North Carolina.”

Assistant U.S. Attorney Matthew R. Petracca is handling the prosecution. The FBI conducted the investigation.

FBI Director Kash Patel issued a pointed statement: “This FBI and our DOJ partners pursued a rigorous investigation that followed the facts — and now Mr. Comey will be held fully accountable for his actions.”

What Comes Next?

As with any federal criminal case, the indictment is the beginning, not the end. The law is clear: an indictment is merely an accusation, and the defendant is presumed innocent until proven guilty. Comey will have the opportunity to retain counsel, enter a plea, and mount a defense.

His defense team will almost certainly argue First Amendment protections around the post — that ‘86 47’ is political speech or protest imagery, not a literal threat. They may also argue the post lacked the specific intent required under Section 871. The government will counter with the reasonable recipient standard and the recklessness theory embedded in Count 2.

What is clear is that this case is headed to trial unless a plea is reached. The charges are serious, the government’s theory is well-constructed, and the defendant is one of the most recognizable names in American law enforcement history.
