ATLANTA — A Georgia mother has filed a sweeping federal class-action lawsuit against three state agencies, alleging the state’s child support system is unconstitutional. The suit, filed by Latorya Johnson, claims Georgia systematically traps indigent parents in a "vicious cycle" of poverty and punishment by issuing support orders based on fictitious income, leading to crushing debt they can never repay.

The lawsuit, spearheaded by the Southern Center for Human Rights (SCHR) and the National Center for Law and Economic Justice (NCLEJ), argues that this practice violates the Due Process Clause of the 14th Amendment. It targets the Georgia Department of Human Services (DHS), the Division of Child Support Services (DCSS), and the Office of State Administrative Hearings (OSAH), seeking to dismantle a policy that plaintiffs say is fundamentally unfair.

A System of 'Impossible' Debt

According to the complaint filed in federal court, the core of the problem lies in the state’s practice of “imputing income.” This is where administrative law judges assign a theoretical income to a parent, regardless of their actual ability to earn money. The lawsuit alleges this is not an exception but a routine practice, even for parents with documented disabilities, those who are incarcerated, or those who are homeless.

This imputed income—often calculated at a full-time, minimum-wage level—is then used to generate a child support order. This creates an immediate and accumulating debt for parents with zero income. Latorya Johnson, the lead plaintiff, exemplifies the harm alleged in the suit. After developing severe medical conditions that left her unable to work, she petitioned the state to modify her child support order. Despite providing medical evidence, her request was denied, and the judge continued to impute income to her. She has since accumulated thousands of dollars in debt and faces the constant threat of having her driver's license suspended or being jailed for contempt.

The lawsuit argues this creates a devastating cycle. When a parent inevitably fails to pay the impossible amount, the state imposes severe penalties:

  • Suspension of driver's and professional licenses, crippling their ability to find work.
  • Negative credit reporting, blocking access to housing and loans.
  • Passport denial.
  • The threat of jail time for civil contempt, which the lawsuit likens to a modern-day debtors' prison.

These punishments, the plaintiffs argue, are counterproductive, making it even harder for a parent to achieve financial stability and support their children.

Due Process and a Departure from Standard Practice

The legal anchor of this case is the 14th Amendment's Due Process Clause, which guarantees fundamental fairness in any government action that deprives a person of life, liberty, or property. The lawsuit contends that basing a child support order—which can lead to the loss of liberty (jail) and property (money, licenses)—on a fictional income is inherently unfair and, therefore, unconstitutional.

In my two decades of experience in family law, the process for setting child support typically requires a rigorous, fact-based assessment of a parent's finances. In states like California, for example, parents must submit a detailed "Income and Expense Declaration" under penalty of perjury. Courts rely on these documents, along with tax returns and pay stubs, to ensure an order reflects a parent's actual ability to pay.

The Georgia lawsuit alleges a stark departure from this standard, particularly in cases where a parent fails to appear in court. Instead of pausing the process to verify financial reality, the state allegedly defaults to imputing income, creating a debt machine that runs in the background. This practice of issuing orders without a realistic financial assessment is precisely what the plaintiffs argue violates the core principle of due process. While imputing income is a valid legal tool in some contexts—for instance, when a parent is voluntarily unemployed to avoid their obligation—the suit alleges Georgia misapplies it punishingly to those who genuinely cannot work.

USA Herald reached out to the Georgia Department of Human Services and the Division of Child Support Services for comment on the pending litigation. As of publication time, no response has been received.

The defendants are now required to formally respond to the complaint in federal court. Their first step will likely be to file a motion to dismiss, which will argue that even if the facts alleged by the plaintiffs are true, they do not constitute a violation of constitutional law. A federal judge will then decide whether the case has enough legal merit to proceed.

The lawsuit does not seek monetary damages. Instead, it asks for declaratory and injunctive relief—a court order declaring the state's practice unconstitutional and forcing the agencies to stop imputing income to parents who have proven they cannot pay. If successful, the case could reshape child support enforcement in Georgia and set a powerful precedent for similar challenges nationwide.
