Kanye West Moves To Dismiss Sexual Assault Lawsuit Citing Free Speech Defense

USA HERALD - Kanye West, one of the most polarizing figures in modern music and culture, is no stranger to controversy. Now, he is asking a Los Angeles County judge to dismiss a sexual assault lawsuit that accuses him of abusing a model during the filming of La Roux’s “In for the Kill” remix back in 2010.

The lawsuit, filed in November 2024 by Jenn An, a reality TV personality from season 13 of America’s Next Top Model, claims that West’s actions during the shoot crossed every possible line. She alleges that West assumed directorial control of the video and, in an unscripted moment, assaulted her while cameras rolled.

According to her complaint, West ordered her to sit, choked her, and shoved his fingers into her mouth while declaring, “This is art. This is f###### art. I am like Picasso.”

The alleged incident lasted more than a minute. An says she struggled to breathe, and that others on set stood by or even encouraged the behavior instead of stopping it. She is now seeking damages for emotional distress and reputational harm.

West’s Counterstrike: Free Speech and Artistic Expression

In a motion filed in August 2025, West’s attorneys pushed back aggressively. They argue the lawsuit has less to do with what happened on set and more to do with West’s inflammatory public persona.

Pointing to references in An’s complaint to West’s past antisemitic remarks and his controversial comments about sexual assault survivors, his legal team says these details are irrelevant to the alleged 2010 incident. Instead, they characterize them as evidence of a broader attempt to silence West because of his views.

“These alleged quotations bear no relevance to the claims in this case and are presented without meaningful context,”his lawyer wrote. “Their inclusion should be considered as facts to support arguments regarding [An’s] motive to bring this lawsuit — to silence [West] for his controversial speech on matters of public concern.”

The defense frames the incident as part of a provocative music video performance — not a crime. West’s team claims the video shoot involved physical interaction between performers, that An never objected, and that she could have walked off set but chose not to.

“At no point during the production did [An] object to her role, express a lack of consent to participate, nor attempt to leave the performance,” the filing states.

The Slippery Slope Argument

Perhaps the most striking part of West’s motion is its broader warning to the entertainment industry. His lawyers argue that if An’s lawsuit is allowed to proceed, it will expose directors, actors, and artists to liability every time provocative art involves depictions of violence or sexuality.

“To permit such claims to proceed would mean that every actor, director, and artist involved in provocative film, theater, or music video productions — whether depicting violence, sexuality, or both — could face retroactive criminalization,” the filing warns.

In other words, West is attempting to transform his defense into a test case for free expression in performance art — raising constitutional questions that may extend far beyond his personal legal troubles.

Plaintiff’s Response: “This Was Not Art”

Jenn An’s attorney, Jesse Weinstein, has dismissed West’s free-speech framing outright. In a sharply worded statement, Weinstein emphasized that what happened on set was not part of the script and not a performance An consented to.

“While Ye is certainly entitled to defend himself in this suit, we refuse to adopt his idea that sexually assaulting Ms. An was somehow justified as ‘art,’” Weinstein said. “This was an unscripted moment that he took it upon himself to create, much to the dismay and shock of nearly everyone around him.”

Weinstein’s framing highlights a tension that courts must often grapple with: the line between consent to artistic performance and exploitation disguised as art.

Broader Legal Context

The lawsuit against West is far from an isolated matter. His mounting legal entanglements have become a hallmark of his career’s later chapters.

  • In June 2024, his former assistant Lauren Pisciotta amended her complaint accusing him of sexual assault, battery, and sex trafficking.
  • Former Yeezy staffers have filed separate suits alleging workplace misconduct.
  • Employees tied to his Donda Academy have also brought actions, citing both labor law violations and hostile working conditions.

Each case amplifies the narrative of an artist whose personal and professional lives have been repeatedly overshadowed by legal controversies.

What the Court Must Decide

This case will likely hinge on two core issues:

  1. Consent and Context— Did Jenn An knowingly agree to participate in provocative physical interactions as part of the shoot, or was the act outside the scope of performance?
  2. Free Speech vs. Harm— Can West successfully frame the alleged assault as protected artistic expression, or will the court treat it as conduct that falls outside constitutional protections?

California courts have long recognized the importance of free expression, but they also draw clear lines when speech or performance involves physical harm or coercion. That tension makes this case particularly significant.

What’s Next

Court records indicate that the next procedural step will be the court’s ruling on West’s motion to dismiss. If the motion is denied, the case will proceed into discovery — a phase that could involve depositions of witnesses present at the shoot and review of any surviving video footage.

If discovery moves forward, both sides will likely litigate fiercely over whether the footage constitutes evidence of assault or performance. Trial could be scheduled for late 2026, depending on the court’s docket.

Meanwhile, settlement discussions cannot be ruled out. Given West’s history of high-profile litigation, his legal team may prefer to avoid a public trial, while An’s counsel may push for a jury to hear the case.
