CHANDLER, AZ - A routine Arizona summer turned into a devastating tragedy for social media influencer Emilie Kiser when her three-year-old son, Trigg, drowned in the family’s Chandler backyard pool on May 18. As shockwaves rippled through the community and beyond, Kiser and her family were forced to confront not only their grief but also the relentless public scrutiny that often follows social media personalities.

By May 27, Kiser had turned to the courts for help—filing a lawsuit in Maricopa County Superior Court aimed at blocking the release of public records related to her son’s death. The family’s legal battle spotlights a critical—and often controversial—question at the crossroads of privacy, press freedom, and open government: When should public records remain confidential, even in cases that grip the public’s attention?

The Legal Fight: What’s at Stake

Kiser’s lawsuit, filed with the assistance of attorney Kevin O’Malley, seeks to prohibit the disclosure of documents typically considered public: police reports, 911 recordings, and scene photographs from the day of the drowning. According to the complaint, neither Kiser nor her legal team have reviewed these materials, but they fear that the contents are “exceptionally raw and graphic,” and that their release would “intrude upon personal dignity or cause unnecessary harm” to the grieving family.

The complaint further details Kiser’s struggle to care for her surviving infant son, Theodore, while facing “a media frenzy” that, in the words of her legal team, has robbed the family of a private space to mourn.

Inside the Courtroom: Key Developments

The first significant hearing took place on June 3. Kiser’s attorney told the court that some redacted versions of the requested records might be suitable for public release, acknowledging Arizona’s tradition of public access but emphasizing the family’s need for privacy. Following arguments, all parties agreed to an interim order—a temporary ban on releasing any records related to Trigg’s death until the lawsuit is resolved.

Notably, several agencies originally named in the complaint—including the Chandler Police Department and the Arizona Department of Health Services—were dismissed from the lawsuit. These agencies were dropped because they hadn’t filed formal responses, and, at least for now, the main defendants are the City of Chandler, Maricopa County, the County Attorney’s Office, and the County Medical Examiner.

The court also ordered that Kiser’s own written declaration—originally attached to the complaint in redacted form—be sealed, ensuring it will remain confidential unless the court orders otherwise.

The Law Behind Public Records in Arizona

Under Arizona law, police reports, 911 calls, and other investigative documents are classified as public records. The rationale is rooted in government transparency and accountability. However, the law also allows for redactions to protect victims, and courts can withhold records if releasing them would cause “substantial and irreparable private or public harm.”

The Kiser case brings this tension to the forefront. According to court filings, more than 100 public records requests have been submitted to both the City of Chandler and the Maricopa County Medical Examiner’s Office. Kiser’s lawsuit alleges that many of these requests were made for “commercial purposes”—a characterization that, if proven, could weigh in the court’s balance, though Arizona’s Ombudsman states that requests for news reporting are not considered commercial by law.

The Arguments: Privacy vs. Public Interest

The Family’s Position

Kiser’s legal team argues that releasing the records—especially in their raw form—would only serve to deepen the family’s anguish, amplify online harassment, and potentially expose surviving family members (including her infant son) to further trauma. They cite the extraordinary pressures facing families in the public eye and suggest that media and private actors are exploiting the tragedy for clicks and commercial gain.

The Other Side

On the other hand, media organizations and open-government advocates point out that public records laws exist for a reason: to allow the public (including journalists) to scrutinize how police and public officials handle cases, especially those involving sudden or accidental deaths.

Public records advocates argue, that these type of records are necessary for the public to  hold officials accountable, even when the details are uncomfortable or tragic.

A National Conversation on Privacy and Public Records

Cases like Kiser’s are becoming more common in the age of viral news and online influencers. Families caught in the media glare—whether due to tragedy or controversy—often seek protection from the unrelenting gaze of both mainstream and social media.

Arizona’s laws give courts wide latitude to balance these competing interests. Past rulings have recognized that privacy concerns sometimes outweigh the public’s right to know, especially where victims are minors or the records contain intensely graphic details.

What Happens Next?

With the temporary ban in place, all eyes are on Maricopa County Superior Court as it determines whether the public’s right to know must yield to a grieving family’s need for privacy. The judge’s final decision could impact not just this family, but future access to police records and emergency calls in tragic cases statewide.

As of publication, no trial date has been set for the next hearing. Legal experts predict a contentious fight—one that could echo in courts across the nation as lawmakers, courts, and citizens debate where to draw the line between privacy and transparency.
