Trump Orders EPA to Expand ‘Freedom to Fix’ Vehicle Repairs in Sweeping Move Targeting California’s Emissions Bottleneck

For millions of Americans struggling with rising vehicle ownership costs, one of the biggest expenses often comes after the purchase—repairing the vehicle. On Monday, President Donald J. Trump signed a presidential memorandum directing the Environmental Protection Agency (EPA) to take immediate steps aimed at lowering those repair costs by expanding what the administration calls the "Freedom to Fix."

The memorandum represents another significant chapter in the administration's broader deregulatory agenda, but unlike many previous executive actions focused primarily on manufacturers, this directive directly targets the cost consumers pay when their vehicles require emissions-related repairs.

At the center of the order is a longstanding issue that has frustrated independent repair shops, aftermarket parts manufacturers, mechanics, agricultural equipment owners, and vehicle enthusiasts for years: the uncertainty surrounding whether certain replacement emissions-related parts comply with the federal Clean Air Act.

The administration argues that existing regulatory uncertainty has driven repair costs higher while effectively allowing one state—California—to control much of the nation's aftermarket emissions-parts certification process.

According to the White House, obtaining a California Air Resources Board (CARB) Executive Order certifying an aftermarket emissions part now frequently takes well over a year, even when manufacturers have completed all required testing and documentation. That delay, the memorandum states, has created supply bottlenecks, increased costs, slowed innovation, and limited consumers' access to affordable replacement parts.

The administration contends that because CARB's certification process has become the only widely recognized pathway for demonstrating Clean Air Act compliance, manufacturers across the country have effectively become dependent upon California regulators to sell emissions-related replacement components nationwide.

The memorandum directs EPA Administrator Lee Zeldin to issue guidance within 30 days clarifying exactly what vehicle owners may legally do when repairing emissions systems on their own vehicles or when having those repairs performed by independent mechanics.

That guidance is expected to answer questions that have long concerned both consumers and repair businesses regarding the Clean Air Act's prohibition against "tampering" with emissions controls.

The administration's position is that Americans attempting, in good faith, to restore their vehicles to their original operating condition should not face uncertainty about whether those repairs could be viewed as unlawful emissions tampering.

Perhaps the most consequential portion of the memorandum instructs the EPA to begin encouraging organizations other than CARB to submit proposals for certifying aftermarket emissions-related parts under federal law.

The agency is directed to review those requests on an expedited basis and provide assurances, when appropriate, that proposed certification systems satisfy Clean Air Act requirements while protecting manufacturers' confidential business information and intellectual property.

If successfully implemented, this policy could fundamentally alter the marketplace for emissions-related replacement parts by creating additional certification pathways outside California's existing system.

Supporters argue that increased competition among certifying organizations could reduce approval times, expand the availability of compliant replacement components, and lower prices for consumers.

Manufacturers that have historically waited months—or even longer—for regulatory approval could benefit from multiple certification options rather than relying upon a single administrative process.

Independent repair facilities likewise may gain broader access to federally compliant aftermarket components, potentially allowing them to complete repairs more quickly and at lower cost.

The memorandum also carries potentially significant enforcement implications.

President Trump directed the EPA to consider deprioritizing civil enforcement actions against individuals who, acting in good faith, attempt to restore their own vehicles to their original factory configuration.

While the memorandum does not eliminate the Clean Air Act's prohibition against emissions tampering, it signals a shift in enforcement priorities toward distinguishing between individuals attempting legitimate repairs and those intentionally modifying vehicles to circumvent emissions requirements.

Legally, however, the memorandum leaves important questions unanswered.

The Clean Air Act remains federal law, and presidential memoranda cannot rewrite statutes enacted by Congress. Instead, the directive focuses primarily on how the EPA interprets existing law, issues guidance, establishes administrative certification procedures, and exercises enforcement discretion.

Whether future administrations maintain these policies—or reverse them—may ultimately depend upon future regulatory actions or judicial review.

The memorandum also highlights an ongoing debate over the balance of power between federal regulators and California.

For decades, California has exercised unique authority under federal environmental law through waivers allowing the state to establish more stringent vehicle emissions standards than those required nationally. Because of California's size and influence within the automotive market, manufacturers frequently design products to satisfy California's requirements, which often become the practical national standard.

The administration's latest action reflects its broader effort to reduce what it characterizes as California's outsized influence over nationwide regulatory policy.

The economic implications could extend well beyond passenger vehicles.

The memorandum specifically references agricultural equipment and non-road machinery, sectors in which repair restrictions have drawn increasing criticism from farmers, equipment owners, and advocates of the broader "Right to Repair" movement.

For manufacturers of aftermarket emissions equipment, the order may create new opportunities to enter markets previously slowed by lengthy certification timelines.

Consumers, meanwhile, could eventually see lower repair costs if additional compliant replacement parts become available through a more competitive approval process.

Whether those anticipated savings materialize will largely depend upon how quickly the EPA develops alternative certification pathways and whether qualified testing organizations step forward to participate.

The coming months will likely determine whether the memorandum produces immediate marketplace changes or instead becomes the beginning of another prolonged legal and regulatory dispute over environmental compliance, consumer choice, and federal regulatory authority.

One point, however, is already clear.

The administration has made reducing the cost of vehicle ownership—and expanding Americans' ability to repair their own vehicles—a central component of its broader effort to reduce everyday consumer expenses, placing the automotive repair industry squarely at the center of one of the most consequential regulatory debates of the year.
