Few products carry higher stakes than the formula parents feed their infants — and few failures cut deeper than allegations that safety corners were cut on something so fundamentally fragile. That reckoning has now arrived for Abbott Laboratories, which the U.S. Department of Justice says has agreed to pay more than $385 million to resolve False Claims Act allegations tied to contaminated infant formula manufactured at plants in Michigan and Arizona.

What the Settlement Actually Resolves

The deal puts an end to a federal lawsuit and investigation stemming from a February 2022 recall of formula produced at Abbott's Sturgis, Michigan, facility, according to the DOJ. At the heart of the government's 2025 complaint was an allegation that powder infant formula from the plant had been purchased by government programs despite failing to meet statutory and regulatory requirements — essentially, product that shouldn't have passed muster still made its way into taxpayer-funded programs.

Breaking Down the Dollar Figures

Under the terms of the agreement, Abbott will pay roughly $348.7 million to the federal government to resolve the FCA allegations, plus an additional $36.3 million to certain states to settle claims tied to Medicaid and WIC programs — splitting the financial reckoning between federal and state coffers.

A Pattern of Patchwork Fixes

The government's case painted a troubling picture of the Sturgis facility's conditions. Roof leaks were reportedly a recurring problem at the plant, and rather than implementing a permanent fix, Abbott allegedly relied on temporary measures to redirect the water — even though the resulting damp environment created elevated risk for microbial contamination, according to the DOJ. The complaint also claimed Abbott used spray dryers to convert liquid formula into powder despite documented cracks in that same equipment, further compounding the contamination risk like a leaky roof over an already compromised foundation.

Officials Weigh In on Accountability

"It is critical that infant formula manufacturers adhere to regulatory and contractual requirements to ensure that the products they manufacture are safe for the babies who consume them," said U.S. Attorney Timothy VerHey for the Western District of Michigan. He added, "This settlement demonstrates our commitment to holding manufacturers accountable when the United States pays for noncompliant products" — a statement that frames the settlement as both a resolution and a warning to the broader industry.

Allegations of Hidden Test Results

Beyond the physical plant conditions, the government's suit also alleged something more deliberate: that Abbott purposefully avoided testing for bacterial growth and failed to disclose test results showing "micro" contamination when responding to FDA inquiries during inspections conducted in 2019 and 2022 at the Sturgis facility — allegations suggesting the problems weren't just structural, but also involved withheld information.

The Recall That Started It All

Back in February 2022, the FDA issued a warning urging consumers to avoid Abbott's Similac, Alimentum and EleCare powdered infant formulas originating from the Sturgis plant, citing potential contamination with cronobacter — a bacteria capable of causing serious, even fatal, illness. That warning followed reports of infant hospitalizations and one infant death linked to the bacteria, prompting Abbott to voluntarily recall the affected products and temporarily halt production at the plant that same day.

Abbott Pushes Back on Causation

In its own Monday statement, Abbott struck a markedly different tone, asserting that four years of government investigations and testing produced no evidence tying its formula to the deaths or illnesses that originally prompted the recall. The company pointed to FDA findings from March 2022, which confirmed that unopened formula collected from the homes of affected infants tested negative for the bacteria. Abbott also cited a later conclusion from the Centers for Disease Control and Prevention, which found no definitive link between the Sturgis plant and the investigated cases.

Abbott's Defense of Its Practices

"Abbott has fully cooperated with every government inquiry related to this matter across administrations of both political parties, providing extensive records and access to dozens of employees," the company said, framing its response as one of transparency rather than evasion.

A Broader Industry Comparison

Abbott further argued that it rigorously tests all infant formula sold in the U.S., including specifically for cronobacter and salmonella, while noting that cronobacter itself is a fairly common bacteria found across various environments, including homes and manufacturing facilities alike. The company didn't stop there, pointing out what it sees as an uneven standard applied specifically to its operations: "In fact, since 2022, multiple infant formula manufacturers have reported Cronobacter-related findings in manufacturing facilities – and, in one instance, in finished, distributed product. None have been subjected to this level of scrutiny."

In the end, the settlement closes the legal chapter even as the scientific debate over causation lingers in the background — a reminder that in cases involving infant health, the cost of doubt alone can run into the hundreds of millions.
