The Crime Novelist on the Bench: How a Missing File Let a Suspect Arrested Six Times in 107 Days Walk Free

Barcelona magistrate Graziella Moreno Graupera has spent a decade writing noir fiction about how real courts work. On September 26, a real court's paperwork failed her: the robbery file she needed to decide on pretrial detention was sitting in another courtroom. The case now continues before Plaza 15.

In her novels, Graziella Moreno Graupera's courts are places where the truth is buried under silence, pressure and missing pieces. Her 2025 thriller La hora de la fuga ("The Hour of Escape") is, in one reviewer's summary, about how the truth stays hidden because of institutional pressure and self-interest (yo leo Novela).

On Saturday, September 26, the Barcelona magistrate faced a real case with a missing piece. She was sitting as the duty judge for detainees when Catalan police brought her 19-year-old Ayoub Touabi, an Alegerian immigrant who was arrested for the violent June 24 robbery of an American hotel guest on the Barceloneta boardwalk. The police file listed five earlier arrests since June 10. The file on the robbery itself was not there.

She ordered him released without bail. Her written order says why: the documents she was sent did not identify the victim, describe his injuries or say what was taken. Those records existed. They were held by another court, Plaza 15 of Barcelona's Instruction Section, which has had the June robbery file since July 4.

Judge by day, novelist by night

Moreno Graupera was born in Barcelona in December 1965 and studied law at the University of Barcelona. Before the bench she worked as a congress hostess, sold books, looked after children and taught at an academy preparing candidates for public exams. She joined the justice administration in 1991, working in instruction and labor courts. She became a judge in 2002 through the entry route for experienced jurists, and served in Gavà, Amposta and Martorell before moving to Barcelona. Since 2010 she has sat on Barcelona Criminal Court No. 6, a trial court that hears and sentences criminal cases (Wikipedia).

Alongside her caseload she has built one of the more visible literary careers in the Spanish judiciary. Her debut, Juegos de maldad (2015), introduced an unconventional fictional judge, Sofía Valle (Lecturalia). Roughly a novel a year followed.

Graziella Moreno Graupera's novels, 2015–2025.

  • Juegos de maldad (2015), El bosque de los inocentes (2016) and Flor seca (2017), published by Alrevés (Alrevés)
  • Querida Elsa (2018) and Invisibles (2019), which received special recognition from the QSD Global Foundation in 2020
  • El salto de la araña (2020), winner of the Castellón Provincial Council's Letras Mediterráneas Prize for best noir novel
  • Los animales de ciudad no lloran (2022), the subject of a Barcelona Bar Association book event with the author (ICAB)
  • La hora de la fuga (AdN, October 2025): a woman is murdered on her wedding night, her bride vanishes, and suspicion falls on a former prosecutor turned struggling writer (yo leo Novela)

She has said her aim is realism. "The idea is to explain how a real court actually functions, which has nothing to do with the American system or what you see in movies and series," she told Diario de Teruel in 2018. She added: "Reality always surpasses fiction... in many cases we have to tone down reality so that fiction doesn't seem so strange" (Diario de Teruel). In another interview she described her work on the bench as "continuous contact with people who face the consequences of their acts or omissions" (Hojas Sueltas).

The case that reached her courtroom

The suspect's arrests recorded by the Mossos d'Esquadra. Arrests are not convictions.

The robbery began the transatlantic litigation USA Herald has followed since June. Just after midnight on June 24, a group of men wrenched the arm of an American guest of the Sofitel Barcelona Skipper behind his back and tore a Rolex Sky-Dweller worth about $51,400 from his wrist. He has since sued Accor S.A., the hotel's operators and general manager Matthias Bernard in Los Angeles for not less than $5 million (USA Herald).

At 2:10 a.m. on September 25, Mossos d'Esquadra officers on patrol stopped Ayoub Touabi on the Passeig Marítim. He was already wanted: the police's regional operations unit had issued an order to find and arrest him. He was held as the presumed author of the June 24 robbery and assault. The police file records five earlier arrests: theft on June 10, violent robbery on June 16, theft on July 25 and August 6, and violent robbery on August 21. All were in the Ciutat Vella district. Counting the September arrest, that is six in 107 days.

A file split between two courts

How the robbery records and the detention decision ended up in different courtrooms.

The miscommunication came from how Spanish police files are built. The Mossos wrote up the June 24 robbery on June 25 and delivered it on July 4 to Plaza 15, the instruction court responsible for investigating it. When the regional unit added information on September 21, that extension also went to Plaza 15, on September 24. The report written after the September 25 arrest was another extension of the same case. It went to whichever judge was on detainee duty that weekend, and it was sent without the earlier reports attached.

That judge was Moreno Graupera, at Plaza 3. Her order, in Diligencias Previas 1504/2026, spells out the gap:

"The report sent to this court on duty was not accompanied by the initial reports; it only indicates that the events took place on June 24, 2026, between 00:15 and 00:30 at Paseo Marítimo de la Barceloneta 36. The identity of the alleged victim is unknown, as are the injuries he may have suffered, what was taken from him, whether or not there were other participants, and whether the offense was completed. It is for this reason that the public prosecutor has not requested the adoption of any measure."

The American victim, who appears in the case as a private prosecutor through Barcelona counsel Joaquín Sugrañes and Alba Roura, asked for pretrial detention. The defense opposed it, and the prosecutor asked for nothing. With no record of the victim, the injuries or the loss in front of her, the judge found the evidence of who committed the robbery not yet established. She noted the suspect had an address and a Spanish foreigner identity number and showed no sign of fleeing. She ordered provisional release without bail, with the usual obligations: give an address for notifications and appear when summoned.

Questions the order leaves open

The order explains what the judge could not see. It says less about what she could. The five prior arrests were listed in the same police file she received, and the order does not discuss them. Spanish law allows pretrial detention to prevent the risk of further offenses, and prior wanted-person orders count toward flight risk. Since April 10, the multirreincidencia reform (Ley Orgánica 1/2026) also lets judges bar a suspect from a neighborhood specifically to stop repeat offending, a lesser step than jail (Sepín).

Barcelona has spent the past year trying to close exactly these gaps. The city now has extra criminal courts, cases against repeat thieves are reaching trial in days rather than months, and judges have begun banning repeat offenders from particular zones (Metrópoli Abierta). None of that helps if the file that would justify those measures never reaches the judge deciding them.

Next stop: Plaza 15

The duty judge's ruling was a stopgap. It resolved only whether the suspect would be held over the weekend. The investigation belongs to Plaza 15, which has the complete record: the victim's identity, the medical report of his injuries and the description of the stolen watch. The victim's lawyers can ask that court to revisit the suspect's situation with the full file in hand, and can challenge the September 26 order itself.

In Los Angeles, the civil case continues. It alleges the Sofitel knew guests were being robbed of luxury watches "at least once a week" and chose not to warn them because signage "would not match the décor" (USA Herald).

Moreno Graupera has written a decade of stories about what happens when the truth doesn't make it into the room. On September 26 it didn't make it into hers and Ayoub Touabi went free without bail...6th arrest in 107 days, and back to the street.  Whether it gets to Plaza 15 is now up to the court that has had the full file since July.
