Ban on Elon Musk’s X

Saturday tens of thousands of supporters of former President Jair Bolsonaro took to the streets in Sao Paulo, Brazil’s largest city. The anti-government rallies took place on the country’s Independence Day where the massive crowds also protested the Supreme Court’s ban on Elon Musk’s X (formerly known as Twitter). 

Some of the protestors claim that the recent ban on the social media platform highlights a fierce struggle over free speech and censorship. 

On August 30, 2024, Brazilian Supreme Court Justice Alexandre de Moraes ordered the platform to be taken offline. The judge accused Musk of refusing to comply with court orders to remove accounts spreading hate speech and misinformation. 

This decision has divided the nation, bringing global attention to the growing debate on social media regulation.

A Political and Social Flashpoint

The ban comes at a pivotal time in Brazil, with municipal elections set for October 6. Conservative politicians have seized on the court’s decision to galvanize their supporters, accusing the judiciary of attempting to censor right-leaning voices ahead of the elections.

Many view this move as a direct attack on free speech, rallying supporters of former President Jair Bolsonaro, whose term ended 20 months ago.

The protests against the ban serve as a critical barometer for Bolsonaro's enduring influence. While he is no longer in office, the demonstrations show that Bolsonaro, along with his supporters, remains a potent political force as the country heads into municipal elections.

The Battle Between Musk and de Moraes

At the center of the controversy is the conflict between Elon Musk and Justice Alexandre de Moraes. 

De Moraes banned X following months of legal wrangling with Musk, who refused to remove accounts that the court accused of disseminating harmful content.

 This clash is not just a legal issue but a cultural and political flashpoint, as it places Brazil at the center of a broader global debate over the regulation of social media.

De Moraes’ critics argue that his actions have crossed the line into censorship. Supporters of Bolsonaro, who have rallied behind Musk, believe that the judge is stifling free speech under the guise of combating hate speech. 

Francisco Carlos, a businessman draped in Brazil’s flag at a São Paulo protest, echoed these sentiments, stating, “Our freedom is at stake…they used to burn books to silence people, now they ban social media.” Carlos, once an avid user of X, called for the impeachment of de Moraes, a sentiment shared by many protesters.

São Paulo Erupts in Protest

Thousands of Bolsonaro supporters, dressed in Brazil’s national colors of green and yellow, took to the streets. Street vendors sold flags bearing Musk’s face and T-shirts depicting de Moraes in jail, while heavily armed police watched over the massive gathering. 

The atmosphere was charged with political fervor as demonstrators handed out election flyers and chanted for free speech.

The protests were as much about Musk as they were about the future of Brazil's political landscape. 

A report from The Wall Street Journal captured the tone of the demonstrations. Valter Viniz, a party supply store owner, was quoted as saying, “We consider Musk a Brazilian now…a superhero.” He went on to call Musk “the only guy who was brave enough to take on that charlatan,” referring to de Moraes.

The Impact of Ban on Elon Musk’s X 

 According to reports, 22 million Brazilians were active on the platform, with over 200,000 signing up in August.

The ban’s symbolic significance far outweighs its practical effects. X has become a battleground for free speech and political power, with Musk emerging as a champion for those who feel disenfranchised by the country’s left-leaning government.

De Moraes, on the other hand, has defended his actions by pointing out Musk’s failure to comply with Brazilian laws. The judge claims that Musk has repeatedly ignored court orders to remove accounts, refused to pay $3 million in fines, and failed to appoint a legal representative in Brazil—a requirement under a 2002 law.

Musk refuses to hire another in-country legal representative citing harassment by the judge. De Moraes threatened to jail Musk’s previous legal director prompting her to resign. After she left X in August, the judge froze her bank accounts. 

 

The Broader Political Context

The legal battle over X is just one part of a broader campaign by de Moraes targeting Bolsonaro and his supporters.

 De Moraes has led investigations into Bolsonaro’s activities, including allegations that the former president attempted to smuggle undeclared diamonds and falsified his Covid-19 vaccination certificate. Bolsonaro, who denies the charges, has described the investigations as a “witch hunt.”

De Moraes and his allies argue that tighter regulation of the internet is necessary to prevent incidents like the January 2023 riots, in which Bolsonaro supporters stormed Brazil’s Congress, presidential palace, and Supreme Court. The uprising, organized primarily online, was a direct attack on the newly inaugurated government of President Luiz Inácio Lula da Silva.

The president who has praised de Moraes for his efforts to rein in social media platforms like X. He also described the January riots as an attempted coup. He also said that de Moraes’ stand against Musk should serve as a warning to the world about the dangers of unfettered online speech.

 While Brazil’s constitution guarantees freedom of expression under Article 5, there are significant limits on what can be said publicly. Defamation of public officials, for example, is considered a criminal offense and the court does not allow any criticism of the sitting government.

A Global Debate on Free Speech

The protests and legal battles surrounding the ban on X have brought Brazil to the forefront of a global conversation about free speech and social media regulation. Musk and his supporters argue that de Moraes has overstepped his authority, using the courts to silence dissenting voices.

 As Musk noted in one of his posts on X, de Moraes’ orders often provided no explanation for why certain accounts were taken down and always targeted conservatives. The sweeping censorship raises concerns about transparency and accountability.

Bolsonaro, who joined the protests on Brazil’s Independence Day, spoke out forcefully against the government and judiciary, declaring that “a country without freedom has nothing to celebrate on this date.”

 For Bolsonaro and his supporters, the fight over X is part of a larger struggle for freedom of speech, political power and control of the narrative in Brazil.
