Sources familiar with the situation tell USA Herald that the Trump administration is preparing a sweeping “defensive” operation targeting activist judges at both the state and federal levels—especially in California, where sanctuary policies often clash with federal immigration law.
Santa Clara County, home to San Jose, is high on their radar.
In recent months, many lawyers, litigants, and legal observers have complained about systemic bias in Santa Clara County courts, where many allege that certain judges are showing a dramatic shift in favoring undocumented litigants.
“It’s become a pattern,” one attorney, who asked to remain anonymous for fear of retaliation, told USA Herald. “Judicial discretion is being abused as a political weapon.”
In California, judicial discretion allows judges flexibility in decision-making—but when discretion morphs into outright manipulation to favor illegal immigrants, it’s an abuse of power that undermines public confidence in the judiciary.
Under appellate standards, this kind of behavior would be classified as “abuse of judicial discretion,” a legal term describing when a judge acts arbitrarily, irrationally, or outside the bounds of established law.
Many litigants facing biased courtrooms have reported that judges in Santa Clara County routinely use discretion not to pursue justice, but to promote their personal political agendas—particularly around immigration issues.
