Pro Se Litigants Turn To ChatGPT As Courts Confront The Promise And Peril Of AI-Powered Justice

The courtroom doors have always been open to self-represented litigants in theory. In reality, however, countless Americans walk into courtrooms every year carrying nothing but stress, incomplete paperwork, and a legal system they barely understand. Now, a rapidly growing number of those litigants are walking in with something new at their side — artificial intelligence.

And courts are starting to notice.

A new wave of litigation and courtroom disputes involving the use of OpenAI’s ChatGPT is forcing judges, attorneys, and legal analysts to confront a difficult question that may shape the future of American justice for decades to come: Is AI helping ordinary people gain meaningful access to the legal system, or is it creating a dangerous shortcut filled with misinformation, fabricated legal citations, and procedural chaos?

The answer, at least for now, appears to be both.

Across the United States, pro se litigants — individuals representing themselves without attorneys — are increasingly relying on AI tools to draft complaints, prepare motions, organize evidence, summarize case law, and even strategize litigation. For many Americans facing crushing legal fees, the appeal is obvious. A consultation with a private attorney can cost hundreds of dollars per hour, while AI platforms can instantly generate legal-style documents in seconds.

But the rise of AI-generated legal filings is producing dramatic highs and devastating lows.

In several widely publicized cases, courts have sanctioned attorneys and litigants after filings generated through AI contained nonexistent judicial opinions, fabricated quotations, or entirely fictitious legal citations. Judges have openly expressed concern that litigants may be placing blind trust in software they do not fully understand.

At the same time, legal reform advocates argue that critics are missing the bigger picture.

The American legal system is already overwhelmed with self-represented litigants. Family courts, eviction courts, probate courts, small claims courts, and dependency courts routinely see individuals forced to navigate highly technical legal procedures without counsel. In many jurisdictions, legal aid organizations are stretched beyond capacity, leaving vulnerable litigants effectively abandoned.

Against that backdrop, AI is rapidly becoming what some view as a digital legal survival tool.

The implications are enormous.

For the first time in history, a single mother facing eviction, a father fighting for visitation rights, or an elderly person dealing with financial abuse can instantly access legal explanations, procedural guidance, and drafting assistance that previously required expensive legal representation. While AI cannot replace licensed counsel, it is undeniably lowering informational barriers that have historically locked millions of Americans out of meaningful participation in the justice system.

That reality is making many in the legal establishment uneasy.

Some attorneys warn that AI-assisted litigation may flood courts with poorly researched filings and increase the burden on already strained judicial resources. Others fear the unauthorized practice of law concerns that arise when users begin treating AI-generated outputs as definitive legal advice rather than informational assistance.

Yet critics of that position say the legal industry itself helped create the conditions for this disruption.

Legal representation has become financially unattainable for many middle-class Americans. Hourly rates in major metropolitan areas routinely exceed $500 per hour, while even basic litigation can cost tens of thousands of dollars. As a result, many litigants simply give up, default, or attempt to represent themselves with little more than internet searches and guesswork.

AI has entered that vacuum.

“The legal industry may not like it, but the reality is that many Americans already cannot afford justice,” I told USA Herald. “Artificial intelligence is not creating the access-to-justice crisis. In many ways, it is exposing how severe the crisis already was.”

What makes the situation even more complicated is that AI systems are improving at extraordinary speed.

Early AI-generated filings often contained glaring errors that were easy to identify. Today’s systems are significantly more sophisticated. Modern AI tools can summarize lengthy rulings, identify procedural rules, organize exhibits, and explain complex legal doctrines in plain language. Some litigants are now using AI to prepare discovery responses, appellate outlines, and detailed declarations that appear professionally structured.

That evolution is forcing courts into unfamiliar territory.

Judges must now balance competing concerns: protecting the integrity of judicial proceedings while also recognizing that AI may become one of the few realistic tools available to economically disadvantaged litigants.

Some courts are beginning to quietly adapt. Judges increasingly ask litigants whether filings were AI-generated. Bar associations are issuing guidance regarding attorney use of AI. Law schools are debating how future lawyers should ethically integrate AI into practice. Meanwhile, technology companies continue racing to develop more advanced legal-assistance capabilities.

The larger societal implications may ultimately extend far beyond the courtroom.

Insurance companies, corporations, government agencies, and major law firms already use sophisticated technology and automated systems in high-stakes decision-making. Critics argue that denying ordinary citizens access to comparable technological tools would create an even greater imbalance of power.

Others fear a future where courts become inundated with machine-generated litigation, making it increasingly difficult to distinguish legitimate claims from automated legal spam.

Both concerns are real.

But beneath the headlines and controversy lies a deeper truth many Americans already understand firsthand: the legal system is extraordinarily difficult to navigate without professional help. AI did not invent that problem. It simply arrived at a moment when millions of people were already desperately searching for assistance.

The courts are now being forced to confront what may become one of the defining legal and technological questions of this generation — not whether AI belongs in the justice system, but how far its role will ultimately go.

And for pro se litigants standing alone before judges, the answer may carry life-changing consequences.
