Following years of litigation and a motion for class certification in November 2022, settlement discussions began in December 2023 while the certification request was still pending. Walgreens has maintained that it acted within the law, with spokesperson Fraser Engerman noting that the company “admits no wrongdoing” and views the claims as “meritless.” Engerman further stated that the savings program was introduced to provide affordable access to medications and that the settlement will allow Walgreens to focus on broader business strategies.

Legal Representation

The plaintiffs, including consumers and union groups, are represented by attorneys Joseph P. Guglielmo, Erin Green Comite, and Amanda Rolon of Scott+Scott Attorneys at Law LLP, along with David W. Mitchell, Arthur L. Shingler III, Paul J. Geller, Mark J. Dearman, and Stuart A. Davidson of Robbins Geller Rudman & Dowd LLP.

As Walgreens moves forward, the settlement represents a notable resolution in the ongoing debate over transparency and fairness in prescription drug pricing for insured and uninsured customers alike.
