A Texas law could redefine the state's role in handling illegal immigration. In a bold move challenging federal immigration authority Texas Senate Bill 4, is set to be signed by Governor Greg Abbott. 

The new state law marks a significant departure from the traditional approach to immigration enforcement. This bill not only grants the police the authority to arrest illegal migrants but also empowers local judges to order their deportation.

Texas Law passed

If signed into law, the Texas Senate Bill 4 would rank among the strictest immigration measures nationwide.  It enables police and judges to arrest and deport specific categories of illegal migrants within the state. 

Unlawful entry, under this legislation, would be classified as a state misdemeanor, carrying a potential punishment of up to two years in prison. However, the law would exclusively apply to recent arrivals, raising questions about its implications and the timeline for implementation.

Unlike previous measures, this law presents a comprehensive approach, empowering all Texas police officers to detain migrants suspected of illegal entry.

Even though the offense, is a misdemeanor it could lead to deportation upon a judge's order. 

Democrats Criticize Texas Senate Bill 4

While the bill has yet to take effect, it has already encountered resistance. Democrats have accused supporters of racial bias, and the Mexican government has voiced concerns about potential family separations and racial profiling.

Critics of the law also argue that it may result in the wrongful arrest of U.S. citizens and legal immigrants. Democrats also expressed concerns that the fear of deportation might deter immigrant crime victims from contacting law enforcement. 

Republican Representative David Spiller emphasized that the law excludes residents who have been in the country for more than two years. He assures that the legislation includes sufficient safeguards, with authorities primarily applying it near the border.

Despite these reassurances, legal experts and immigrant rights groups have strongly opposed the Texas bill, claiming it infringes on the federal government's authority to regulate immigration.

 Democratic Representative Victoria Neave Criado questions the state's power to deport individuals, asserting that such authority lies exclusively with the federal government.
